Executive Order on Increasing the Minimum Wage for Federal Contractors
On April 27, 2021 President Biden issued an executive order requiring federal contractors and subcontractors to pay a $15 minimum wage to workers and pay at least $10.50 to tipped workers. For tipped workers, the order also requires an incremental increase in the minimum wage up to the general federal contractor minimum wage by January 30, 2024. (The current minimum wage for workers on federal contracts is $10.95 per hour and the tipped minimum wage is $7.65 per hour.) This all starts to kick in on January 30, 2022. On and after January 30, 2022 contracting officers will be required to include the new minimum wages in all of their new contracts and in any options or renewals that are exercised in their existing contracts.

CISA and NIST Release New Interagency Resource: Defending Against Software Supply Chain 
To help software vendors and customers defend against these attacks, CISA and the National Institute for Standards and Technology (NIST) have released Defending Against Software Supply Chain Attacks. This new interagency resource provides an overview of software supply chain risks and recommendations. The publication also provides guidance on using NIST’s Cyber Supply Chain Risk Management (C-SCRM) framework and the Secure Software Development Framework (SSDF) to identify, assess, and mitigate risks. 
HUBZone Program: Extending Map Freeze
This direct final rule extends the HUBZone map freeze mandated by the National Defense Authorization Act for Fiscal Year 2018 (NDAA 2018) from December 31, 2021, to June 30, 2023.
Novation Agreements Under Federal Contracts
 
A unique aspect of doing business with the federal government is the built-in limits on a contractor’s right to assign the contract or the right to payment under the contract to third parties. The Anti-Assignment Act (41 U.S.C. § 6305) prohibits the transfer of a government contract or interest in a government contract to a third party.  An assignment of a contract in violation of this law voids the contract except for the Government’s right to pursue a breach of contract remedies. 
SAM.gov is merging into beta.SAM.gov
 
In preparation for the SAM.GOV transition, the following notices have been issues
  • ALERT: SAM.gov will be down for scheduled maintenance Saturday, 05/15/2021 from 8:00 AM to 1:00 PM.
  • ALERT: SAM.gov will be completely unavailable due to scheduled maintenance from Friday, May 21 at 4:00 PM EST through Monday, May 24 at 9:00 AM EST as it is upgraded to the modernized environment. Learn more

On May 24, 2021, SAM.gov will migrate into beta.SAM.gov, and the two systems will become one (known as SAM.gov - the “beta” goes away). At that time, several non-federal roles will change in the modernized environment. Role names will be simplified and the number of roles reduced from four to three.  We recently held an online Stakeholder Forum where we discussed many upcoming changes. Please click here to watch a recording and download the slide deck from that meeting.
