JUST IN: TikTok Ban Issued for Federal Government Contractors

A new Federal Acquisition Regulation clause prohibits contractors from “having or using” TikTok on any devices used to conduct official business.

The new FAR clause, published on June 2, builds on February White House instructions to federal agencies to eliminate TikTok from official networks and requires federal contractors to amend their policies to comply with the interim rule by July 3.

Reminder to Federal Contractors and Subcontractors: Certify Your AAP Compliance by June 29

As a reminder, and as we had reported in an earlier Blog Post, Federal Contractors and Subcontractors are asked to certify their compliance with the Affirmative Action Program obligations under Executive Order 11246, VEVRAA, and Section 503 of the Rehabilitation Act by no later than June 29, 2023 (the end of this month).

According to the Office of Federal Contract Compliance Programs (OFCCP), “[c]overed federal contractors and subcontractors must use the Contractor Portal to certify, on an annual basis, whether they have developed and maintained an AAP [(Affirmative Action Program)] for each establishment and/or functional/business unit, as applicable.” Certification is required by June 29, 2023, for all current contractors. New contractors have 120 days to develop their AAPs and are required to register and certify compliance via the Portal within 90 days of developing their AAPs; for this reason, the Portal will remain open this year after the June 29 certification date.

Department of Defense Strengthening Efforts to Counter Unwanted Foreign Influence on DOD-Funded Research at Institutions of Higher Education

The Department of Defense today announced the publication of a list of foreign entities that have been confirmed as engaging in problematic activity as described in Section 1286 of the Fiscal Year 2019 National Defense Authorization Act, as amended. These include practices and behaviors that increase the likelihood that DOD-funded research and development efforts will be misappropriated to the detriment of national or economic security or be subject to violations of research integrity or foreign government interference.

"Protecting and maintaining the integrity of our research enterprise is integral to national security," said Heidi Shyu, Under Secretary of Defense for Research and Engineering (USD(R&E). "The publication of these foreign entities underscores our commitment to ensuring the responsible use of federal research funding and safeguarding our critical technologies from exploitation or compromise."
