Prompt Pay for Construction: Are you owed 1% per month on your state/local public work?


Cash flow is the lifeblood of any small business—especially when working on public construction contracts. Washington State law provides important protections to ensure timely payments. Under RCW 39.76, public agencies must pay prime contractors within 30 days of receiving a proper invoice. Once paid, prime contractors have 8 days to pay their subcontractors. Understanding and leveraging these prompt pay requirements can help your small businesses stay financially stable.

  • DBE Program – Nationwide, the Disadvantaged Business Enterprise program remains closely watched as litigation challenging the constitutionality of key components of the program continues to advance through the court system. This article linked here from the law firm Piliero Mazza outlines components of the court case. Locally, listening sessions to be scheduled later this month with WSDOT and OMWBE will be helpful to understand the implications of potential rulings. In the meantime, DBE certified firms are invited to meet with their local APEX Advisor to discuss strategies for diversification if they are heavily reliant on DBE’s competitive advantages in transportation contracting.
  • FAR Overhaul –The FAR Overhaul page on Acquisition.gov has been launched featuring guidance on the changes as they roll out. The Office of Federal Procurement Policy and Federal Acquisition Regulatory Council (FAR Council) is working on a full-scale rewrite of the Federal Acquisition Regulations. Changes will be released on a rolling basis and adopted by agencies through the deviation process until the full changes make their way through the rule making process. During this time of change, APEX Advisors recommend you fully understand the FAR clauses referenced in your current contracts, and watch for changes in future solicitations – especially ones that may impact your long term profitability. This will require a bit more time and consideration at the bidding stage, but can be critical to the compliance and success of your firm.
