xxxxxOn June 17, 2021, the defendant ran a stop sign at Greenwood Road and Old Washington Highway in Henrico County, crashing into our client's F-150. Seeking treatment for neck pain and radiculopathy, the client visited BetterMed, his PCP, and the VCU emergency room. Though referred to physical therapy, he treated at home. After a gap in care due to a severe COVID hospitalization, persistent symptoms led him to an orthopedic surgeon. When epidural steroid injections failed, he underwent a three-level neck surgery, followed a year later by a revision surgery to repair his neck.

xxxxxThe defense denied liability, alleged contributory negligence, and argued the client failed to mitigate damages during the care gap. They called a well-known defense expert who attributed both surgeries to pre-existing degenerative disc disease from 2016. The defense's top offer before trial was $200,000.

xxxxxFollowing a two-day trial, the legal team of James McCauley, Ryan Walker, and Jamie Sinnott secured a verdict of roughly $1.3 million after under two hours of jury deliberation.
