SBA Develops Loan Necessity Questionnaires for PPP Borrowers Over $2 Million
Last week, the Small Business Administration quietly announced that it has developed two distinct versions of a PPP loan necessity questionnaire: one for for-profit borrowers, and one for non-profit borrowers – both only for PPP borrowers of loans over $2 million.

SBA did not issue a public announcement other than a Federal Register notice marking the release of the forms, which has reportedly confused banks that provided PPP loans, which according to the forms, would be responsible for delivering the questionnaires to the agency. PPP borrowers of over $2 Million have also raised alarm over the several new questions for businesses in the nine-page questionnaire — which the SBA said borrowers must complete within 10 business days of receiving it. The questions ask for details on quarterly revenue, capital expenditures, dividend payments and whether any employees earned more than $250,000.

According to the forms, the questionnaires will be utilized by the SBA in its review of the PPP borrower’s good-faith certifications of the borrower’s economic need saying they “will be used to inform SBA’s review of your good-faith certification that economic uncertainty made your loan request necessary to support your ongoing operations” and that the forms will “maximize program integrity and protect taxpayer resources.” 

The agency also highlights on the forms that the failure to complete the form may cause the SBA to determine that a business was ineligible, and the agency may seek repayment “or pursue other available remedies.”

ABC will continue to provide updates on these questionnaires as we receive additional information.
ABC President Brian Sampson Interviewed by Spectrum News Show: Capital Tonight
ABC Empire State Chapter President Brian Sampson was interviewed by Capital Tonight calling for State Legislators to join together and create an “Upstate Caucus” that would act to support and grow Upstate New York.

In the interview, Brian is referred to as the Chairman of the Unshackle Board, and in lieu of there being a current Executive Director of the organization, he gets to be the face and voice of that organization as well. We Need Lower Taxes
It’s no secret that New York is a high spend, high tax state. But it doesn’t need to be that way. There are changes that New York can make without compromising the services we
expect and the quality of life we deserve.

This past Friday, in partnership with our friends at Unshackle Upstate, I published a Speaking Out piece in the Empire Report. The Empire Report is New York’s most widely read morning website where reporters, elected officials and taxpayers go to get information. You can read our piece HERE.

We’re sharing this with you and the full membership today as a reminder that we will never stop fighting for you, your business and your employees. While our emphasis is always on construction, we’ll fight against tax and spend policies that force our friends and family to flee our state for better opportunities elsewhere. It’s a never ending battle and we will not give up.
New York State Paid Sick Leave Webinar Recording
As you know, as part of the fiscal year 2020-2021 budget, New York State passed a Paid Sick Leave Law that kicked in on September 30, 2020. The law requires all New York state employers, depending on the size of the company, to provide paid sick leave to employees. The amount of leave you are mandated to provide is dependent on the number of employees in your company. Last week ABC Member firms Goldberg Segalla and Direct Advisors hosted a webinar on how to be in compliance with New York State's new Paid Sick Leave Law. Reminder: New Travel Guidelines
Please be advised that New York State has once again changed their travel guidelines. New York will no longer maintain its weekly list of “naughty” states but instead will require all travelers to get tested. Here’s what you need to know:

  • The new protocol is effective Wednesday, November 4

  • Essential workers will continue to be exempt

  • For any traveler to New York State from out of state, exempting the contiguous states, the new guidelines for travelers to test-out of the mandatory 14-day quarantine are below:
  • For travelers who were in another state for more than 24 hours:
  • Travelers must obtain a test within three days of departure from that state
  • The traveler must, upon arrival in New York, quarantine for three days
  • On day 4 of their quarantine, the traveler must obtain another COVID test. If both tests comes back negative, the traveler may exit quarantine early upon receipt of the second negative diagnostic test
  • For travelers who were in another state for less than 24 hours:
  • The traveler does not need a test prior to their departure from the other state, and does not need to quarantine upon arrival in New York State
  • However, the traveler must fill out our traveler form upon entry into New York State, and take a COVID diagnostic test 4 days after their arrival in New York

  • Travelers from states that are contiguous with New York will continue to be exempt from the travel advisory; however covered travelers must continue to fill out the Traveler Health Form. Essential workers will continue to be exempt as well.

  • These new guidelines ONLY APPLY if you want to opt of the mandatory 14-day quarantine. If you’re willing to quarantine, no testing is required.

Travelers will be monitored by their local Department of Health and if needed they will reach out to other regions of the state and country to ensure proper tracing is in place.
