HOA Bills to Watch

House Bill 327: Homeowners Association Modifications - Rep. Jordan Teuscher: This bill requires an association to notify an owner in writing if the HOA denies the owner's plan to modify or improve their unit. The bill also places limitations on an association's ability to impose certain rules regarding flags, basketball hoops, and gardens.


House Bill 86: Homeowners' Association Requirements - Rep. Walt Brooks: This bill increases the monetary amount a unit or lot owner may request if an association fails to properly make records available for examination. The amount of relief owners could request would increase from $500 to $1,000. The bill also amends provisions relating to the period of administrative control for associations of lot owners.


House Bill 217: Homeowners' Association Amendments - Rep. Neil Walter: This bill establishes the Office of the Homeowners' Association Ombudsman and the office's duties, jurisdiction, and functions.


The bill also makes the following changes:

  • Only allows a homeowners' association transfer fee if it is used to pay expenses related to the transfer itself.
  • Establishes requirements for a homeowners' association to impose a reinvestment fee.
  • Changes requirements for amending governing documents and late fees.

House Bill 430: Security and Land Restriction Amendments - Rep. Candice Pierucci: Prohibits a person from purchasing an interest in land on behalf of a restricted foreign entity and creates a criminal offense for a person purchasing land on behalf of a restricted foreign entity.


Senate Bill 262: Housing Affordability Modifications - Sen. Lincoln Fillmore: This bill creates the option for a municipality to create a residential density overlay for the development of single-family dwellings on small lots and diverse housing options.
