NJDEP Issues Guidance on REAL Legacy Provisions

The New Jersey Department of Environmental Protection (NJDEP) has issued updated guidance explaining how the agency intends to apply the proposed extension of the NJPACT REAL legacy period. The guidance outlines which coastal, freshwater wetlands, flood hazard area, and stormwater permit applications may continue to be reviewed under pre-REAL regulations if they qualify for legacy status. It also provides additional clarification regarding application completeness, permitting timelines, local approvals, and project eligibility.
