Weather forecast: π₯ HOT π₯
With temps ranging in the 90s, take special care and precaution when out and about on the jobsite. Modify work schedules, arrange frequent rest and water breaks in shaded or air-conditioned areas, drink plenty of fluids often and BEFORE you're thirsty, avoid beverages with alcohol and caffeine, slather on the sunscreen, and dress in lightweight, loose-fitting, and light-colored clothing.
Use the buddy system, and let someone know if you or a team member feel dizzy, weak, stop sweating, or appear to be confused and/or unable to think clearly. These could be signs of Heat Exhaustion or Heat Stroke. Stay safe and look forward to cooler temps soon!

Non-Compete Agreements for Independent Contractors
|
Effective as of July 1, 2023, Minnesota has banned employment non-compete agreements and restricted provisions that require non-Minnesota laws or venues for disputes.
The ban applies to any agreement that would restrict the employee or independent contractor, after termination from performing:
(1) work for another employer for a specified period of time;
(2) work in a specified geographical area; or
(3) work for another employer that is similar in nature to the employee's previous role.
The bill applies to both employees and independent contractors, regardless of income. The bill also restricts employers from including choice-of-law or choice-of-venue provisions that require disputes to be resolved outside of Minnesota or to require the application of non-Minnesota law. Learn More

Minnesota's New Cannabis Law
|
Minnesota's new cannabis law amends the state's Consumable Products Act (CPA) to protect off-duty cannabis use. The law also amends Minnesota's Drug and Alcohol Testing in the Workplace Act (DATWA) by excluding cannabis from the definition of "drug" and by creating two different workplace drug testing schemes based on whether positions are exempt from the cannabis testing prohibitions.
The Association of General Contractors (AGC) included the following in their July 21, 2023, newsletter regarding the new Minnesota cannabis law:
"The Minnesota Cannabis law is new and provokes questions, uncertainties, and potentially, problems. One key unknown is how it applies to construction zones. AGC-MN's position is that the construction worksite is exempt from the new law because the worksite is safety sensitive. This means that, for the construction worksite, AGC believes that there should be no change in your drug policies or procedures, and anyone on the worksite (a) can be tested for cannabis consistent with the other drug and testing laws, and (b) be disciplined or terminated if cannabis is found consistent with your policies and drug laws."
AGC suggests that you consult with an attorney and update your business' policies to clarify that for persons going on a construction worksite, cannabis is still considered a drug under Minnesota law. Other sites (such as a non-construction worksite, like an office) would be subject to the new Minnesota law permitting cannabis use.
To help raise awareness of this important safety issue, AGC created this template for companies to print as a poster or flyer for use within construction zones.
Answers to frequently asked questions regarding the new law on adult-use cannabis can be found here.

π·π½ββοΈ This Women-Led Business is Redefining Construction Workwear
When landscape designer Kate Day moved to Portland, Oregon, in 2009, she worked in the dirt and flowers with friend and fellow landscaper Kyle Marie Begley. In 2013 the pair decided to open a landscaping business. Shortly after, the friends ran into one major frustration: their workwear. They just needed a pair of workpants that fit and functioned. With the help of their client, Sara DeLuca, the women spent a year developing the perfect pants for their own personal needs --- gardening, landscaping, etc. Thus, the Maven Slim Pant was born. It was a perfect mid-rise design with plenty of pockets and just enough structure while still allowing for comfortable movement. Day and DeLuca cofounded Dovetail Workwear in 2018 and has been designing and producing functional, fashionable, and durable gear supporting women in trade, outdoor, transportation and beyond. π¦Ί OSHA Proposes Rule to Clarify PPE Standard for Construction Industry
The current standard does not state clearly that PPE must fit each affected employee properly, which OSHA's general industry and maritime standards do. The proposed change would clarify that PPE must fit each employee properly to protect them from occupational hazards. The news follows the U.S. Department of Labor and OSHA's previous announcement regarding a National Emphasis Program to protect workers by preventing falls, the leading cause of fatalities in the workplace.
