After Funding

Successful originators in the commercial equipment finance and leasing industry understand a simple truth: funding a transaction is not the finish line. It’s the starting point.

Once the vendor is paid and the commission hits the account, the life cycle of the transaction begins. Every condition in the lease or finance agreement (every covenant, every guarantee, every obligation) must be fulfilled by the customer over the term of the agreement. That performance is what protects the portfolio, the funding partners, and the originator’s reputation.Yet not everyone sees it that way.

A newer originator once told me:

“After funding, it’s operations’ problem. My job is done.”

He believed delinquencies and charge‑offs were the result of operations mishandling details. He believed his responsibility ended when the deal was booked. That mindset is not only wrong, it’s dangerous. Originators who think this way eventually learn the hard way that every transaction they originate has their name on it forever. And nothing teaches that lesson faster than a courtroom.

One of the greatest lessons in this industry is learned standing before a judge, defending your documents, your processes, and your decisions. Early in my career, as a credit analyst, I was required to appear in court on a transaction that had gone bad. I had never been in a courtroom before. Prior to my appearance, I read every document repeatedly to ensure I understood every paragraph. We lost the case. Not because of credit. Not because of collateral. Not because of structure. We lost because of a simple documentation error. That day I learned:

  • Cutting corners is expensive.
  • Misrepresenting documentation during the sales cycle creates real risk.
  • Processes matter.
  • Documentation is everything.

Since then, I’ve appeared in court dozens of times defending documents, explaining processes, and serving as an expert witness. Every appearance reinforces the same truth:

Funding a transaction is only the beginning.

Top originators understand the full life cycle of a transaction. They know how documentation protects the company. They understand why operations must be a trusted partner, not a dumping ground. They recognize that funding partners and investors rely on their judgment long after the deal closes. They can defend their actions, their processes, and their documentation in any courtroom. Top originators don’t just sell financing. They protect portfolios. They safeguard reputations.

They elevate the industry.
