Court Rules Against Minnesota State Chamber in Minneapolis Lawsuit on Earned Sick and Safe Leave

The City of Minneapolis can now enforce its earned sick and safe leave ordinance against employers based outside its boundaries, the Minnesota Court of Appeals ruled Monday. The court had previously upheld the ordinance for businesses located within the city. The Minnesota Chamber was the lead plaintiff in the lawsuit that was filed in 2016 when the ordinance took effect. This decision will impact businesses throughout the metro area. If you have employees spending more than 80 hours in Minneapolis your business will have to provide safe and sick leave.

The ruling makes it very clear that the Legislature should pass a law that explicitly prevents local governments from enacting their own wage and benefit mandates. This is the only way for there not to be competing and conflicting city-based mandates on these matters. The Minnesota State Chamber is evaluating whether to appeal the decision to the State Supreme Court.

Written comments can be submitted by June 7, 2019.
