BOMA California Bad Bills Alert

SB 1359 (Stern) Gas Infrastructure Phase-Out

Represents a significant shift in how natural gas infrastructure is planned and phased out, with direct implications for development and building operations.

  • Restricts new gas infrastructure and prioritizes electrification, even where feasibility is uncertain
  • Limits new gas service for certain developments, creating design and cost challenges
  • Accelerates asset retirement and shifts costs that will ultimately impact property owners and tenants

SB 1361 (Durazo) Transit-Oriented Housing Expansion

Expands by-right transit-oriented housing and overrides local development standards near transit, including on commercially zoned properties.

  • Allows residential by-right on commercially zoned sites, creating conflicts with existing commercial uses
  • Could lead to residential encroachment near industrial areas, similar to issues raised with SB 79 and AB 98
  • Overrides local height, density, and development standards while layering additional requirements

SB 954 (Blakespear) Manufacturing CEQA Rollback Limits

Would significantly undermine SB 131 (2025), which established a CEQA exemption for advanced manufacturing projects in California.

  • Narrows eligibility and limits which projects can qualify for the exemption, creating uncertainty for investment
  • Imposes new requirements including setbacks, community benefit agreements, zero-emission backup generation mandates, and LEED Gold certification
  • Requires gubernatorial approval and layers of additional environmental standards, increasing cost, delay, and political risk
  • Effectively reintroduces CEQA-style barriers, undermining the intent of streamlining advanced manufacturing

SB 1075 (Reyes) Emissions Control Overreach Expansion

Expands and strengthens community emissions reduction requirements, increasing regulatory oversight on development and industrial activity.

  • Requires state review and approval of local emissions reduction plans, adding a new layer of oversight and potential delay
  • Elevates community emissions reduction plans in ways that could conflict with or override local land use planning frameworks
  • Creates additional compliance obligations and enforcement mechanisms that increase legal and operational risk for development projects
  • Adds uncertainty for development projects, particularly in areas subject to air quality constraints

AB 1764 (Ahrens) - Mixed-use Development Implications Bill Pulled for the Year

Assemblymember Patrick Ahrens has pulled AB 1764 from the legislative docket following early committee discussions and stakeholder engagement. We appreciate Assemblymember Ahrens and his staff for their engagement on this issue and their continued commitment to working collaboratively toward a more workable solution and thank him for pulling the bill. The measure aimed to increase grocery access in designated food deserts, however as drafted, the bill raised significant concerns for mixed-use and commercial development projects.

Skyler Wonnacott, BOMA California's Vice President of Government Relations, delivered primary opposition testimony during the March 25 Assembly Agriculture Committee hearing. As drafted, the bill would have imposed a new state-level constraint on commercial land use by conditioning housing approvals on requirements to preserve grocery store capacity or provide mitigation. This would have added costs, created delays and uncertainty, and established a precedent of tying housing approvals to specific commercial use mandates outside of local zoning and planning decisions.

For mixed-use projects in particular, the bill created a structural challenge by requiring developers to plan around a specific tenant type regardless of market demand. This undermines flexibility in project design, complicates financing, and makes it more difficult to deliver housing in already challenging development environments.

BOMA California engaged early alongside the California Building Industry Association, working directly with the author’s office. Due to these lobbying efforts, the bill has been pulled for the remainder of the year. BOMA California is committed to continuing to work with the Legislature on a more balanced approach in the fall and thanks the California Apartment Association and NAIOP SoCal for joining in opposition at the committee hearing.

BOMA California Sponsored Bill Alert

AB 2418 (González) is one of BOMA California's sponsored bills this year. This measure is also co-authored by Assemblymembers Wicks, Rubio, Nguyen, and Zbur and aims to address prolonged local plan-check delays for nonresidential projects and establishes clear, enforceable timelines for permit review.

AB 2418 would:

  • Require local agencies to provide an estimated plan-check timeline upon deeming an application complete.
  • Shorten the definition of “excessive delay” from 50 days to 30 days and allow use of a qualified private plan checker when timelines are exceeded.
  • Require permit issuance (or written notice of noncompliance) and final inspection within firm 10-business-day deadlines in specified circumstances.

This is a targeted reform designed to bring predictability and accountability to nonresidential permitting while preserving local oversight.

Big thank you to our local co-sponsors NAIOP SoCal and BOMA Greater Los Angeles for their partnership and support on this effort.
