Government Affairs Update

BOMA California Pushes Back Against Bad Bill Raising Janitorial Costs

BOMA California is actively advocating against AB 2374 (Haney; D – San Francisco), which would transform the Displaced Janitor Opportunity Act into a joint liability statute under which any size company becomes liable for the failure of a contractor to comply with the Act. If passed, companies would be responsible for new notice and scheduling obligations for workers who are not its employees. Further, AB 2374 sets a troubling precedent by binding an employer to a collective bargaining agreement that its new employee was previously under even though that employer had no role whatsoever in the bargaining process.

BOMA California Supports Bill Delaying Fees That Impede Housing

Your advocates in Sacramento visited the Senate Local Government Committee meeting to advocate for SB 937 (Wiener; D – San Francisco), which would defer cities’ collection of development fees (also known as impact fees), allowing more housing projects to pencil out.

The legislation also extends permit entitlements, allowing projects on pause due to high interest rates to retain their permits until market conditions improve. The bill passed 6-0 and heads next to the Senate Housing Committee.

BOMA California Opposes Bill Detrimental To Coastal Conservation

BOMA California is advocating against AB 3192 (Muratsuchi; D - Torrance) due to several over-arching concerns with the legislation which render it unnecessary and detrimental to coastal conservation efforts. The legislation appears to unfairly target a small subset of visitor-serving businesses along the coast and asserts that “major coastal resorts” pose more environmental impact than other developments along the coast.

CalChamber expects several additions to the list in the coming weeks.
