Commercial Rent Control Bill Advances

Earlier this week, CBPA issued a call to action urging members to oppose Assembly Bill 380 (Gonzalez; D–Los Angeles), which proposes major changes to California’s emergency price gouging laws by extending them to commercial leases. The bill would override existing contracts, cap rent increases during declared emergencies, ban evictions even for nonpayment, and block property owners from recovering increased costs related to insurance, taxes, or repairs. It also allows local governments to extend these restrictions indefinitely—creating long-term market uncertainty. CBPA is leading a coalition of over 25 business groups in strong opposition.

Yesterday, AB 380 initially passed the Assembly by just two votes, with many Democrats and all Republicans voting no or abstaining, in support of our position. Thank you to everyone who contacted their representatives in opposition. We’ll keep you informed as the bill moves to the Senate.

Key Wins Secured For Commercial Real Estate

Last week, we reported that SB 789 (Menjivar; D–Van Nuys)—originally a commercial vacancy tax bill, later narrowed to vacancy reporting—was defeated, thanks in part to strong opposition from our industry. Our advocacy continues to influence other bills that would negatively impact commercial real estate.


  • AB 863 (Kalra; D–San Jose) would have imposed burdensome translation mandates on commercial real estate. Following strong pushback, the author has committed to removing commercial from the bill.


  • AB 1248 (Haney; D–San Francisco) proposed broad lease termination and notice requirements for residential and commercial tenants, including a new “qualified commercial tenant” category. After strong pushback, commercial provisions have been removed.


  • SB 658 (Pérez; D–Los Angeles) initially imposed sweeping mandates on the sale of residential, mixed-use, and fire-damaged commercial properties affected by the 2025 Palisades and Eaton Fires. Due to strong coalition advocacy, all affordability mandates, tenant restoration rules, and resale restrictions were removed.


Tomorrow is a key legislative deadline—the last day for each house to pass bills introduced in that house. Stay tuned for updates on our remaining priority bills.
