Welcome New Members!

Please help us welcome new members Heritage Crop Science and Longwind CropScience USA. Membership dues fund our advocacy efforts which include working with EPA on the PRIA and non-PRIA backlog and on the possibility of giving growers credit for the use of Drift Reduction Adjuvants as an ESA mitigation tool alternative to No-Spray buffers which would be difficult for growers and our members.

Heritage Crop Science

Heritage Crop Science, LLC is a marketing company of branded and post-patent crop protection products. We were founded in 2020 as a means of diversification away from the single active business of our manufacturing/marketing company Kim-C1, LLC.

Longwind CropScience USA

Longwind is committed to providing US growers more scientific options for crop protection solutions at a cost-effective price point. Our company is a wholly owned subsidiary of YIFAN Biotechnology a major supplier of off patent chemistry globally.

President-Elect Trump

On behalf of the Council of Producers & Distributors of Agrotechnology, I would like to congratulate President-elect Donald Trump on his election as well as the representatives and senators elected to serve in the 119th Congress. CPDA is committed to working with Mr. Trump and members of both parties to strengthen our agricultural and rural economy in a way that benefits all Americans.

Transition News: What's Next

In a city that values gossip almost as much as it does political power, Washington DC is abuzz with word of Mr. Trump’s cabinet picks and other political appointees.

A president is responsible for about 4,000 political appointments, 1,200 of which require Senate confirmation. Based on what our political team of Andrew Walmsley, Jay Vroom and Scott Rawlins have learned, here’s the initial speculation of who might serve in key positions.

U.S. Department of Agriculture

These names keep percolating to the top as the next Secretary of Agriculture.

  • Sid Miller. He’s the current Texas Agriculture Commissioner.
  • Kip Tom is the co-chair of the Farmers and Ranchers for Trump coalition. He’s also an Indiana farmer with close ties to former VP Mike Pence.
  • Ted McKinney is the current President & CEO of the National Association of State Departments of Agriculture. He previously served as Trump’s Agriculture Undersecretary for Trade and Foreign Agricultural Affairs. He is also an Indiana native. Ted was a featured speaker during this year’s CPDA Annual Meeting in San Diego
  • Thomas Massie is a Kentucky member of the House of Representatives. Some outlets have already reported that it’s Massie’s job to lose. That seems premature given the fact Republicans hold on the House is yet unknown and the loss of even a single R could temporarily cost them the majority.
  • Greg Doud. Former Chief Agricultural Negotiator at the U.S. Trade Representative’s office during Trump I.
  • Zippy Duvall. President of the American Farm Bureau Federation.
  • Mike Conaway. Former member of Congress from Texas and House Ag Committee Chairman, now a private consultant.
  • Ray Starling. Former USDA Chief of Staff under Secretary of Ag Sonny Perdue.

Environmental Protection Agency

On Monday, the New York Post reported that President-elect Trump has selected former Rep. Lee Zeldin to serve as EPA administrator.

Zeldin represented New York’s Long Island for four terms as a Republican congressman before losing the 2022 New York governor’s race to Kathy Hochul.

In a statement, Trump said:

“Lee, with a very strong legal background, has been a true fighter for America First policies. He will ensure fair and swift deregulatory decisions that will be enacted in a way to unleash the power of American businesses, while at the same time maintaining the highest environmental standards, including the cleanest air and water on the planet.”

Before assuming his post, Zeldin must be confirmed by the Senate.

Senator Thune Elected Senate Majority Leader

CPDA congratulates Sen. John Thune (R-SD) on his election to Senate Majority Leader. Sen. Thune has a deep background in agriculture and is a longtime member of the Senate Agriculture Committee. Below is a picture of Sen. Thune with CPDA Political Advisor Peter Roskam.

EPA Registers New Herbicide Active Ingredient Glufosinate-P: ESA Trouble Ahead?

On October 18, EPA announced that it is registering the new active ingredient glufosinate-P, which controls weeds in conventional and glufosinate-resistant field corn, sweet corn, soybean, cotton, and canola.

As part of this decision, EPA also released its final biological evaluation for glufosinate-P under the Endangered Species Act. Glufosinate-P is the first new active ingredient registration where EPA has used its new Herbicide Strategy to determine the mitigation applicators must employ to reduce exposure to listed species.

Shortly thereafter, EPA posted the final glufosinate-P label, which raised several significant concerns regarding its ESA-related restrictions.

The first restriction of concern is for applicators to maintain a mandatory spray drift downwind buffer between the last spray row and the protection area of fifty feet for aerial applications and ten feet for ground applications. In a press release, the American Soybean Association said this about the new buffers:

“Somewhere between the draft and final registration, EPA without explanation tripled the number of ESA runoff points required and imposed a new 10-foot mandatory ground spray drift buffer farmers must adopt to use the new glufosinate-P herbicide. Growers should be worried about the precedent this will set…”

That’s the bad news. The good news is that the EPA offers several options for reducing the mandatory buffer, including “use of an oil emulsion drift reducing adjuvant that constitutes 2.5% of the volume of the finished spray tank mix.” It’s important to remember that the inclusion of a DRA was not on the table two years ago, but thanks to the CPDA ESA Working Group led by Eileen Bernard of Nutrien and Dr. Connor Ferguson of Simplot it is now.

Second, EPA offers several options for reducing the mandatory buffer, including “use of an oil emulsion drift reducing adjuvant that constitutes 2.5% of the volume of the finished spray tank mix.” It’s unclear how EPA arrived at that percentage and whether it’s reflective of the data CPDA-member companies have submitted to EPA.

Third, the label requires applicators to review "any applicable Endangered Species Protection Bulletins (Bulletins) within six months prior to or on the day of application." Since this label won't be in grower's hands for another 3 or 4 months, no grower will be able to do that.

Since this is the first new active ingredient to go through the new Herbicide Strategy framework, this is troubling news as it portends similar problems and restrictions with other new actives as well as those products going through registration review.

CPDA intends to press EPA on ESA implementation to ensure that new requirements reflect the best available science while avoiding label language that is overly restrictive. We will also continue to press our case for broader inclusion of DRAs across the spectrum of ESA no-spray restrictions.

ESA Mitigation & CPDA's Fight Against No-Spray Buffer Zones

As part of our efforts for ESA mitigation outreach, CPDA is hosting a webinar with CropLife Magazine on November 15th at 2:00 pm EST titled “The ABCs of ESA: Exploring the EPA’s Herbicide Strategy.” So far, the CPDA branded webinar announcement has made over 35,000 impressions with 20,000 emails and 15,000 social media interactions. You can register for the webinar here.

EPA CPDA Collaboration to Reduce Backlog

At the invitation of EPA, representatives of the CPDA-EPA Working Group met with the leadership from EPA’s Registration Division (RD) on November 6 to explore possible revisions to “simple” changes to product registrations via fast-track amendments, notifications, and non-notifications, which are now detailed in Pesticide Registration Notice 98-10, which is due for revision next year.

CPDA has built a good rapport with the RD staff through practical approaches to resolving problems and reducing the workload for EPA and industry alike, and the Nov 6 meeting built on that. Many thanks to Dave Bolin of Atticus, CPDA-EPA Working Group Chair, for spearheading and shepherding this effort. Success will be measured by faster processing of these minor actions and faster time to market for important product changes.

CPDA State Affairs Committee Meeting

The CPDA State Affairs Committee met virtually on November 12th, with a plate full of issues that included:

  • Federal Update to include potential lame duck actions and a new Farm Bill;
