MAYORAL CONTRACT REFORM PANEL MEETS

The Mayor’s Contract Reform Panel held its first meeting. Industry members include BTEA President Louis Coletti, Robert Wessels, Managing Director of the General Contractors Association and Arthur Rubenstein of the Subcontractors Trade Association along with Gary LaBarbera of the Building and Construction Trades Council. The goals of the Committee are as follows:


  1. Reduce the timeline for capital project completion
  2. Increase Taxpayer savings
  3. Enhance participation and inclusion in the process; and
  4. Increase capacity for emerging needs.

 

The Reform Panel will include five committees each co-chaired by a member of the private and public sector. Attached is the presentation made at the meeting by city officials chaired by Lorraine Grillo, First Deputy Mayor.

BTEA ASKS MTA FOR CLARIFICATION OF MARIJUANA TESTING POLICY

The BTEA has written to MTA officials asking for clarification of their contradictory policy which prohibits anyone working on their projects who tests positive for marijuana. However, NYS Department of Labor rules prohibits contractors from dismissing workers and could subject contractors to potential lawsuits. The BTEA had a meeting with Jamie Torres-Springer MTA Chief Development Officer , Cathy Sheridan, Chief of Staff and other officials to discuss this and other issues including a possible Project Labor Agreement for the 2nd Ave. Subway project.

CARLOS LAW UPDATE

The BTEA and other industry associations continue to monitor discussions on this bill which would impose criminal sanctions on contractors and supervisory personnel if accidents or fatalities occur on jobsites. So far, the bill has not moved forward but is expected to and the industry is preparing amendments to be submitted shortly.

STOP WORK ORDERS AN ISSUE

The BTEA is seeking to meet with DOB officials to discuss how they determine to issue STOP Work Orders and whether they are partial or full. Different inspectors seem to have different thresholds, and the industry needs some clarity and framework.
