West Avenue Phase II Improvements

Potential Legal Action

The City of Miami Beach has been notified by Ric‑Man Construction of Florida, the contractor for the West Avenue Phase II project, that the firm may pursue legal action against the city.

Residents can be assured that day‑to‑day construction work will continue without interruption. The agreement governing the design and construction of this project remains in full force and effect.

We are sharing this information in the interest of transparency, although no complaint has been filed as of the time of this communication.

As with any major construction project, particularly one of this scope and complexity, differences may arise regarding responsibilities, scope or performance expectations. The contract includes specific procedures for resolving disputes and requires the contractor to continue performing all work without interruption while those matters are addressed. The city remains committed to working in good faith and fully in accordance with the terms of the contract.

The West Avenue project is designed to enhance the neighborhood’s quality of life through infrastructure and aesthetic improvements, while also reducing long‑term flooding risks. West Avenue is among the lowest‑lying areas in the city, with elevations reaching as low as 1.7' NAVD.
