Safety Tip: Are Trench Excavations Confined Spaces
OSHA is focusing on reducing trenching and excavation hazards. Trench collapses, or cave-ins, pose the greatest risk to workers' lives. To prevent cave-ins:
  • SLOPE or bench trench walls
  • SHORE trench walls with supports, or
  • SHIELD trench walls with trench boxes
Employers should also ensure there is a safe way to enter and exit the trench. Keep materials away from the edge of the trench. Look for standing water or atmospheric hazards. Never enter a trench unless it has been properly inspected.

New OSHA Policy Will Increase Citations and Penalties for Contractors
On January 26, 2023, OSHA announced a significant change to their policy related to instance-by-instance issuance of citations and penalty adjustments that will become effective in 60 days. The current policy has been in place since 1990 and applies only to egregious willful citations. According to OSHA, the policy change is to make its penalties more effective in stopping employers from repeatedly exposing workers to life-threatening hazards or failing to comply with certain workplace safety and health requirements.
In addition to the new enforcement guidance, OSHA reminded Regional Administrators and Area Directors of their authority not to group violations and cite certain types of violations as instance-by-instance citations for cases where the agency identifies “high-gravity” serious violations of OSHA standards specific to certain conditions.

These conditions include lockout/tagout, machine guarding, permit-required confined space, respiratory protection, falls, trenching and for cases with other-than-serious violations specific to recordkeeping, all of which impact the construction industry.
Elements of an Effective Underground Utility Excavation Safety and Damage Prevention Program and Record Keeping, Incidents/Damages Reporting 
AGC’s Utility Infrastructure Division (UID) developed a sample damage prevention program for professional contractors based on Common Ground Alliance Best Practices and input from AGC’s substantial underground utility safety and damage prevention experience and resources.

This sample program includes:
  • Best Practices to help avoid safety incidents and property damage,
  • Record keeping guidelines that help memorialize the 811 process and circumstances related to a damage/incident when they occur,
  • Information on electronic applications that are field friendly, simple and capture comprehensive records in multiple formats to help enhance your program.
  • Guidelines to help defend against sometimes frivolous and fraudulent utility damage claim activities.

AGC Releases Workforce Summit Report
The report, 2022 National Construction Industry Workforce Summit: Success Stories and New Strategies offers a comprehensive summary of AGC’s most-recent workforce summit. This includes over 40 new workforce development solutions crafted by Summit participants, as well as details about what firms, AGC chapters and educators are already doing that is helping address the industry’s workforce needs. The goals is for the report to be a resource for ideas about ways to better recruit, train and retain the industry’s workforce.
