Question:
I had a tenant rent a unit and two days later she came back and said she changed her mind. She demanded a full refund and stated that there is a law that requires me to let her cancel within 72 hours of her signing the lease. Do I have to refund everything to her and cancel the lease?
Answer:
No. You have a binding contract with her, and you may enforce it. What she is referring to is a statute in the Texas Business & Commerce Code. This statute allows a person to cancel a transaction within three days, but only if that transaction involved a door-to-door salesman-type situation. The statute only allows people to cancel their transactions within three days if "the merchant or the merchant’s agent engages in a personal solicitation of a sale to the consumer at a place other than the merchant’s place of business." Unless you go door-to-door trying to sell space at your facility, and the lease is signed at a place other than your facility, the statute does not apply to you at all.
