Tenant Opportunity to Purchase Act (TOPA)
The DC Council, on April 10, passed a bill exempting all single-family houses from the Tenant Opportunity to Purchase Act (TOPA). Last year, hearings held by Housing Committee Chair Anita Bonds exposed how this otherwise tenant-friendly act has been used by attorneys to extort payoffs from homeowners when they went to sell their homes. The hearings found that only 3 times in the last 10 years had tenants in a single-family house actually purchased the residence they were renting by using TOPA. However, thousands of single family homeowners had been extorted into payoffs to attorneys to allow for the sale of their homes to proceed.

DCCA testified at the hearing in support of exempting all owner-occupied properties, which the Single Family exemption partially accomplishes, but at the expense of also exempting many non-owner occupied rental properties. DCCA’s proposal would have restricted the exemption to owner-occupied properties but included in the exemption those owner-occupied properties that had more than one accessory unit attached. Given the size of many of our older rowhouses and townhouses, many homeowners in Dupont rent out attic units, basements, and carriage houses in an effort to help solve the housing crisis in this city. The bill as passed does not exempt owner-occupied properties having more than one of these accessory units. Councilmember Brianne Nadeau proposed a similar amendment to the bill as reported by Urban Turf. Unfortunately, the amendment failed.

DCCA believes TOPA works well for multi-unit apartment buildings where tenants actually are availing themselves of the right to purchase, and that this TOPA exemption for single-family homes, while not the ideal solution, will help maintain affordable rental housing by assuring single-family homeowners with a single accessory unit in their homes that they can rent it out without fear of payoffs down the road. However DCCA regrets that the defining characteristic of the exemption was whether the property was a single family house and not whether it was owner-occupied.
COMP PLAN: Search for Solutions
Our event at the DCJCC this past Friday attracted about 50 people for a discussion by local planning experts about the District's Comprehensive Plan currently under a ten year review. All in attendance agreed that affordable housing is the most critical issue and that it has not been addressed in the Mayor's legislation. Greater Greater Washington's founder David Alpert said the Office of Planning "is not planning." Committee of 100's Meg Maguire renewed their call for Planning to be taken out from under Economic Development.

Thank you to DCJCC for use of Theatre J!
