WHITE HOUSE ANNOUNCES TRIBAL ENGAGEMENT SESSION ON E.O. 14112

What is Happening

The White House Office of Intergovernmental Affairs, the White House Domestic Policy Council, the White House Office of Management and Budget, and the White House Council on Native American Affairs (WHCNAA) announced a virtual engagement session with Biden-Harris Administration leadership to discuss Executive Order 14112 on Reforming Federal Funding and Support for Tribal Nations to Better Embrace Our Trust Responsibilities and Promote the Next Era of Tribal Self-Determination. This virtual session is scheduled for Monday, January 22, 2024, 3:30pm – 5:00 PM ET.


Per the announcement: The Executive Order (EO) demonstrates the Biden-Harris Administration’s respect for Tribal sovereignty and its commitment to ushering in the next era of Tribal self-determination by directing agencies to reform federal programs for greater autonomy of Tribal Nations over how Tribes can invest federal funding. The EO also directs agencies to make federal funding less burdensome and more accessible for Tribal Nations.


During this engagement session, Biden-Harris Administration leadership and staff from the White House and Federal Departments will discuss the substance and implementation process the Administration is planning for EO 14112. Tribal leaders are invited to ask questions, provide comments, and share their perspectives on how EO 14112 can best meet the needs of their Tribal Nations.

Why the Executive Order Matters:

The Executive Order includes provisions that “promote compacting, contracting, co-management, co-stewardship” with Tribes, representing a heightened federal commitment to empowering the expansion of Tribal self-determination. The Executive Order takes several measures to make funding more accessible to Tribes, including streamlining funding applications and reporting processes, allowing Tribes to self-certify data when permitted by statute, and identifying funding programs that can support Tribal set-asides. Furthermore, the Executive Order directs federal agencies to assess how federal funding has fallen short of meeting the federal trust responsibility owed to Tribes and report their findings to the Office of Management and Budget (OMB) and the President. These reports will inform the development of the next President’s Budget, which influences regular funding negotiations.
