WASHINGTON — On Friday, President Biden announced a series of new actions as part of his "Bidenomics" agenda. One of these plans includes guidance on rules against surprise medical bills. The administration, however, is missing the mark again after its bungled regulatory implementation of the No Surprises Act.

Unfortunately, this new guidance fails to address the main issue concerning surprise bills nationwide: the refusal of federal regulators and certified independent dispute resolution entities (IDREs) to process IDR claims in the time frame required by law.

With this announcement, the Biden administration also inexplicably continues to try and pin the blame for surprise medical bills on physicians (emoji emphasis ours).

Instead of attacking our nation's physicians, the White House should be directing its regulatory agencies to crack down on the egregious tactics health insurance companies are using to manipulate the No Surprises Act.

These insurance company actions are leading to:

  • Narrower health plan networks and, subsequently, more out-of-network care;
  • Significantly reduced payments to physicians and hospitals; and
  • Increased cost-sharing and less access to care for patients.

President Biden announced his re-election campaign with the slogan “Finish the Job.” And if he wants his "Bidenomics" agenda to succeed, he should start by doing one job right now: instructing the Department of Health and Human Services, the Centers for Medicare & Medicaid Services, and his other agencies to clear the IDR logjam and immediately stand up a fully functioning IDR process.
