Tax Alert: COVID-19 State Tax Due Date Relief
March 31, 2020 - In response to the postponement of the federal income tax filing and payment deadlines due to the COVID-19 pandemic, most state governments are postponing state income tax due dates for individuals and businesses. A majority of states have conformed to the federal postponement and moved the filing and payment deadlines to July 15, 2020 for all taxpayers, while some states have only provided relief for certain types of taxpayers. A few states have provided due date relief but to dates before or after July 15, 2020. In addition to income tax, most states have also provided relief for sales and use tax, property tax and a variety of other taxes. This alert is based on state tax guidance announced through March 30, 2020. We anticipate additional state tax guidance will be provided over the next few weeks.

State Income Tax
The individual, corporate and partnership income tax guidance issued by Arkansas, California, Florida, Georgia, Illinois, Louisiana, New Jersey, New Mexico, New York, Oklahoma, Pennsylvania and Texas is summarized below.

Arkansas – Arkansas extended the individual and partnership income tax filing and payment deadline to July 15, 2020. The corporate filing and payment deadline has not been extended.

California – California extended individual, partnership, and corporate filing and payment deadlines to July 15, 2020. 

Florida – Florida has not postponed the corporate filing and payment deadline, so the due date remains May 1, 2020. The partnership due date has also not been extended, so the due date remains April 1, 2020. Florida does not have an individual income tax.

Georgia – For both individuals and corporations, Georgia extended the filing and payment due dates to July 15, 2020. The Georgia partnership due date was March 16, 2020, and therefore the due date was not extended.

Illinois – Illinois extended the filing and payment deadlines to July 15, 2020 for individuals, partnerships, and corporations. 

Louisiana - Louisiana extended the filing and payment deadlines to July 15, 2020 for individuals, partnerships, and corporations. 

New Jersey – The due dates in New Jersey have not been extended, however the governor recently stated he will “almost certainly” announce state tax filing extensions. Legislation is awaiting the governor’s signature which would extend the corporate and partnership filing and payment due dates to June 30, 2020.

New Mexico - For both individuals and corporations, New Mexico extended the filing and payment due dates to July 15, 2020. The New Mexico partnership due date was March 16, 2020, and therefore the due date was not extended.

New York – New York extended the filing and payment deadlines to July 15, 2020 for both individuals and corporations. The New York partnership due date was March 16, 2020, and therefore the due date was not extended.

Oklahoma – The Oklahoma Tax Commission issued guidance that the state would postpone the individual and partnership income tax filing and payment deadlines to July 15, 2020. However, the income tax due date for corporations is May 15, 2020 and it has not been extended.

Pennsylvania – Pennsylvania extended the filing and payment due dates for individuals and partnerships to July 15, 2020. The corporate income tax filing and payment due date of May 15, 2020 has not been extended.

Texas – The Texas Comptroller has not postponed the May 15, 2020 franchise tax due date. The Comptroller announced tax relief in the form of postponements on deadlines to remit payments related to existing payment plan agreements, which will be considered on a case-by-case basis.


Other State Taxes
