Private Eyes! Should They Be Watching You?
As technology has advanced, and Associations are looking for ways to increase security and lessen the chances of mistakes being made, some Associations are opting to consider, or actually install, cameras that capture images of license plates entering a community. In light of this trend, is this a good idea for your Association to consider, or do the risks outweigh the reward?
First, it should be noted that your Association’s governing documents should be reviewed as to whether your Association has the power to implement such cameras. If your documents reasonably give such authority, the Association should next make sure that the system would be installed over private streets, or alternatively, in some circumstances, with approval of the appropriate governmental entity. Once that is determined, the Board can make the business decision on whether, or not, to proceed.

Most of the experts with which Clayton & McCulloh has experience believe that the benefits of this technology outweigh the risks. The Association can more quickly determine responsibility for certain damages. Moreover, there is an argument that this is, essentially, the same as a guard at a gate handwriting a tag number. Many argue that with a public license tag number, there is no expectation of privacy.
However, if your Association determines to proceed on this project, there are ways that the risk to the Association can be lessened. Many owners want to have an expectation of what's being done. We suggest signage giving residents and visitors notice of the use of the camera. Moreover, the Association may want to make sure this is a reactive process, with no active monitoring of someone watching the cars coming in and out and writing down license plate numbers concurrently, in order to resolve any direct privacy concerns.
