UPDATES ON LEGISLATION COVERED JAN. 23, 2023

The District aims to keep staff informed on legislation in Santa Fe that has a potential impact on K-12 schools and the district. The Office of the Superintendent will share and update staff throughout the first session of the 56th Legislature.

Proposed legislation are introduced for consideration and then assigned to committees before going for a complete vote. The District will keep track of the legislation and update the location of the bill.

H.B. 130 - Increasing the number of instructional hours

If passed, this bill will increase the number of required instructional hours for students. Current requirements are nine hundred (900) hours for K-6 grades and one thousand eighty (1,080) hours for grades 7-12. The proposed hours in H.B. 130 would be one thousand one hundred and forty (1,140) hours for all grades K-12.


H.B. 130 has been reported by the House Education Committee and House Judiciary Committee with a DO PASS recommendation. H.B. 130 is now in the House Appropriations & Finance Committee.

H.B. 36 - Group insurance contributions for school districts.

Proposes changes to the District contribution in health insurance from seventy percent (70%) to at least eighty percent (80%) of the cost for all employees.


H.B. 36 has been replaced by H.B. 102. New language would require all school districts to cover the first ten thousand dollars ($10,000) of the insurance costs of all employees and at least sixty percent (60%) of the costs greater than ten thousand dollars ($10,000) for all employees. H.B. 102 has been reported with a DO PASS recommendation by the House Education Committee.

H.B. 127 - Increase in salary for Education Assistants (EA's)*

House Bill 127 proposes an increase in minimum salary for education assistants to twenty-five thousand dollars ($25,000) annually. If passed, this would be effective in the 2023-24 school year.


H.B. 127 has been reported by the House Commerce & Economic Development Committee and the House Education Committee with a DO PASS recommendation.


*Currently, state mandated increases are not matched by federal funds.

H.B. 126 - Change in graduation requirements

If passed, House Bill 126 will change the graduation requirements for freshman in the 2024-25 school year. The state requirement will be lowered from 24 credits to 22 credits. This would effect this current school year's 7th graders once they enter the 9th grade.


H.B. 126 has been reported with a DO PASS recommendation by the House Commerce & Economic Development Committee and the House Education Committee.

S.B. 28 - Tax deduction for school supplies

Senate Bill 28 proposes an income tax deduction for school supplies purchased by a public school teacher. This would be a phased in deduction, for tax year 2023 the credit would be five hundred dollars ($500). In tax year 2024, the credit would increase to one thousand dollars ($1,000).


S.B. 28 is in the Senate Tax, Business, and Transportation Committee, no reported hearing date.

S.B. 95 - Funding to the Public Education Dept. for school safety statewide

If approved, the PED will receive funding to improve school security across the entire state.


S.B. 95 has been referred to the Senate Education Committee. No reported hearing date.

S.B. 137 - State requirement of thirty (30) minutes of recess time for grades K-3

S.B. 137 will require that grades K-3 have a mandatory minimum of thirty (30) minutes built into their day for students to have unstructured supervised recess time. This would be in addition to physical education classes.


S.B. 137 has been referred to the Senate Education Committee.

The Deming Board of Education met with Representative Jenifer Jones in Santa Fe to discuss education issues facing the district.

Senator Correa Hemphill met with the Board of Education to discuss issues in Luna County and building a partnership as she transitions into representing our District and County in the New Mexico Senate.

Senator Crystal Diamond hosted the Deming Board of Education on Senate Chambers floor as special guests


Senator Crystal Diamond introduced the Deming Board of Education as her special guests on the Senate Chambers floor. The Board of Education and Superintendent Chavez were on the floor for the unanimous vote in support of Senate Memorial 19 recognizing February 2, 2023 as School Board Appreciation Day.
