Chris Wojtowicz brings over two decades of international business experience across multiple sectors to the Wisconsin Small Business Development (SBDC) Network.

He specializes in creating tailored import/export compliance programs. He also has a proven track record in transforming domestic businesses into successful international businesses, working with small and medium-sized enterprises in the beverage, logistics, manufacturing, medical device and defense sectors.

What Contractors Need To Know About The Biden Administration's "Buy American" Executive Order

President Biden signed an Executive Order on January 25, 2021 professing an intent to bolster "Buy American" requirements in federal government procurements (the "Order").1 While the Order, entitled "Ensuring the Future is Made in All of America by All of America's Workers," makes sweeping policy declarations, its practical impact may be more limited than the title implies. Notably, the Order does not address domestic preference provisions for specific industries that have been of interest, such as pharmaceuticals, and does not impact existing U.S. trade agreement obligations. This article summarizes the major provisions of the Order, identifies its areas of likely impact, and notes certain open questions the Order leaves unresolved.

Sanctions/Export Controls Trends in 2021

The recent change in administrations has generated much discussion about what to expect in the worlds of export controls and sanctions in 2021. In general, we expect many of the same priorities from 2020, including a focus on China and Russia, to continue in 2021, but with a more measured and multi-lateral approach.

Enforcement of U.S. sanctions continued to be strong in 2020. OFAC brought enforcement actions focusing on the e-commerce, banking, shipping, and insurance industries. OFAC has also been focusing on transactions involving the tech sector and the use of digital currencies to evade sanctions (including through ransomware attacks).

Expect the Biden Administration to continue to take a firm, but more measured and multi-lateral approach to China in 2021.
