August 2021
August is National Make a Will Month

No one likes to think about not having the ability to make personal healthcare or financial decisions due to illness, disability or death. However, it can and does happen. Why not have a say in your own future and plan now rather than waiting for a crisis and having others make critical decisions for you? Estate planning is for everyone over the age 18, not just the wealthy and older adults.

We can assist you with your estate planning matters. Our attorneys work closely with our clients to develop a plan that addresses all planning issues, from the financial to the personal; a plan that is custom, yet flexible, and a plan that is both easy for our clients to understand and for their loved ones to administer. Most Adults With Special Needs Require Estate Planning Documents
Disabilities take many forms, and not all of them affect a person with special needs' ability to make decisions. In fact, many people have the capacity to create their own estate planning documents, and in some cases it is crucial that they do so.

One scenario that often arises has to do with "HIPAA", which stands for Health Insurance Portability and Accountability Act of 1996, is the primary federal regulation governing a patient's private medical information. HIPAA gives a patient the right to manage their medical information and regulates who can access that information. Because medical providers must follow HIPAA regulations, it is difficult for loved ones who legitimately need to access another person's medical records, often in an emergency, to do so without a power of attorney for healthcare that authorizes the information's release. Under HIPAA, medical providers in these situations can disclose medical information to patients' families, but they are not required to do so without a release from the patient.
