Q:  We never reclassified our salaried employees who earn less than $47,476.  Given the current legal challenge to the rule change and the incoming Trump Administration, is that okay?

A: Our best answer is, if you've done nothing, it's okay to wait. If you have reclassified your employees or have given some of them a pay increase to accommodate the new threshold, you will need to evaluate how to move forward on a case-by-case basis. Remember, however, that to appropriately classify your employees as exempt (salaried), they need to satisfy not just the salary minimum, but also the duties test. For a refresher on those rules, best to review the US Department of Labor's Fact Sheet #17.
