One-Day Reopening of Comments to the OCR's Rulemaking Portal

The U.S. Department of Education has reopened the comment period for the Department's proposed regulations under Title IX of the Education Amendments of 1972.

During the 62-day comment period, which closed on January 30, 2019, the Department received more than 104,000 comments. To give the public an additional opportunity to comment-particularly anyone who may have experienced technical difficulties using the Federal eRulemaking Portal-the Department is reopening the comment period for one day on February 15, 2019.
As to comments not previously submitted, commenters must submit between 12:00 a.m. and 11:59 p.m. EST on February 15, 2019 through the Federal eRulemaking Portal ( ). Take this extended one-day only opportunity if you missed previously submitting your comments on the newly proposed regulations.

I Ask How to Teach Consent Early , a resource from the National Sexual Violence Resource Center, provides a Palm Card and Handout which  instructs parents and educa tors on how to  model consent with children in late childhood and early adolescence. Late childhood and early adolescence is a time when children get messages about relationships and consent from TV shows, movies, social media, and friends. This makes it an ideal time for parents and educators to have conversations about consent. Talking with them now will encourage open and honest communication as they mature and enter their first relationships.

All over the country, more than 200 lawsuits have attacked the decisions of college panels in sexual misconduct allegations, and many of those decisions are weak and susceptible to challenge in the courts. This training is designed to shore up that weakness so that your decisions are sound, supportable, and much harder to challenge in court.

Additionally, the Office of Civil Rights newly proposed regulations would require Institutions to hold live hearings to resolve every allegation of sexual misconduct. The new rules also mandate that Institutions provide "advisors" to students in these hearings, who may or may not be lawyers; but are mandated by OCR to engage in direct cross-examination of the parties. Our newly created Title IX Hearing Officer Training & Certification addresses this and much more.
