Happy September!
I’m pleased to report that the 2021 Southern California Water Conference returned to the Doubletree Hotel in Ontario, CA on August 13th after a year of Covid restrictions. Last year’s event was a strictly-online Zoom event, and this year’s participants voiced significant satisfaction that a sense of normalcy was returning to California, even in the midst of growing challenges in the water industry. Cucamonga Valley Water District
After granting a public hearing continuance, district officials met to discuss the BIA fee analysis and ultimately reduced the fee increase by nearly 50% last month.
Legislative Briefing
BIA staff was joined by Gary Hester of Crestwood Communities to conducted a legislative briefing on SB 727 with Senator Connie Leyva. The briefing was also in coordination with CBIA. Under SB 727 - “Labor-related liabilities” - Imposes liquidated damages and penalties in excess of 15 times actual damages against general contractors for liabilities they did not cause. This will put homebuilders and other general contractors in the position of paying many times over for the same work and fails to hold bad actors responsible who do not pay their own employees. This overly punitive and redundant penalties will add unnecessary costs that will exacerbate the current housing crisis.
The cost to homebuilders and general contractors that arise from a subcontractor not paying their employees far exceed the liability imposed pursuant to AB 1701. Homebuilders, in particular, not only own and develop the land on which new homes are constructed but they also act as direct contractors for those projects. Once complete, the new home is sold to a homebuyer. AB 1701 made homebuilders guarantors of wage and benefit payments to subcontractor employees – as well as imposing liability for attorney’s’ fees, expert witness and other costs, and interest. This exposed homebuilders (and homebuyers) to the added costs of having to pay twice for the same labor.
VMT
The BIA Baldy View Chapter continues to engage in discussion with the San Bernardino County Transportation Authority (SBCTA) regarding the Vehicle Miles Traveled (VMT) compliance and mitigation as required under SB 743. The SBCTA has prepared a draft VMT calculator to assist cities with the local implementation of SB 743. Upon completion each San Bernardino County city will receive the final version of this tool to calculate the total VMT for each residential project. Those projects that exceed a city’s adopted threshold of VMT will be subject to a yet to be determined set of mitigation requirements aimed at reducing VMT. SB 743/VMT Background
SB 743 was signed into law in 2013. As referenced by the SBCTA, the legislative intent of SB 743 noted changes to current California Environmental Quality Act (CEQA) practice were necessary to balance the needs of congestion management with statewide goals related to infill development, promotion of public health through active transportation, and reduction of greenhouse gas emissions. The Legislature found that with adoption of the Sustainable Communities and Climate Protection Act of 2008 (SB 375), the state had signaled its commitment to encourage land use and transportation planning decisions and investments that reduce Vehicle Miles Traveled (VMT) and thereby contribute to the reduction of greenhouse gas emissions (GHG), as required by the California Global Warming Solutions Act of 2006 (AB 32). As such, VMT is the new metric for transportation analysis which focuses on the overall miles traveled by vehicles within a region. Level of Service (LOS) is no longer used as criteria for determining a significant environmental effect under CEQA. This approach has an added inherent emphasis on reducing greenhouse gas emissions. All cities in the State of California were required to adopt new VMT thresholds by July 1, 2020.

This year’s event focusing on California water issues, was hosted by the Building Industry Association of Southern California Baldy View Chapter in partnership with San Bernardino County, water agencies, cities and businesses. The four main topics for this year’s conference focused on Water and Housing, Water Supply, Water Affordability, and Water Efficiency.
Keynote speaker Jennifer Pierre, General Manager of the State Water Contractors, tied all of the subjects together in a lunch presentation on the Delta Conveyance Project, California’s current effort to restore the efficacy of the California State Water Project (SWP) that feeds fresh water from the Sacramento River Delta to Central and Southern California.
