Tip of the Week

Is Consent Really Like Drinking Tea?

Tip of the Week authored by Brett A. Sokolow, Esq., ATIXA Executive Director

In response to this post on The Dirty Normal, I suppose the educator in me and the lawyer in me are not reconciled.  I can teach “Tea” to an investigator, hearing panel or officer and it works.  If I teach “going beyond tea” to a hearing panel, investigator or hearing officer, all we get to is: sex is messy and sticky well before you ever touch someone because of sexual politics and ethics, and how do you really ever know if there was consent?  It leads to reductionist reasoning that paradoxically works in the responding party’s favor, most times, because we need to draw a line where really all there is is a blur.

ATIXA and Trivie Announce New App-Based Solution: U of Nine

U of Nine is an app-based solution to help colleges and univeTrivie.

U of Nine is approaching the problem of campus sexual misconduct from a fresh, potent and technologically savvy perspective – engaging students on these important topics via their mobile devices. ATIXA has assembled two dozen subject matter experts from across higher education to review and develop the gamified, quiz-based content for U of Nine. Each quiz was subjected to intense focus-group analysis, along with feedback from students on pilot-site campuses around the country. Complying with Campus SaVE and VAWA Section 304

By now, many of you have taken a look at the VAWA Reauthorization section known as the Campus SaVE Act. This amendment changes the Clery Act in ways much more substantive than previous amendments. While amendments before asked us to disclose existing policies, they largely did not require us to create new policies except for the set of amendments contained in the 1992 Campus Sexual Assault Victim's Bill of Rights. Now, those disclosures and rights have been largely eclipsed by the SaVE amendments, which will require us to develop significant new policy language, much of the content of which is prescribed by the SaVE Act. Final regulations were released in October 2014 by the Negotiated Rulemaking Committee, requiring changes to the Clery Act effective July 2015. Start planning now, because there is a lot to this new law. This template is available from The NCHERM Group for $249. To purchase our SaVE disclosure template, visit our online store. For additional questions, contact Michelle Issadore at (610) 993-0229, extension 1002.

  • Module 1: Hearing Board Competencies
  • Module 2: Title IX-Based Competencies
  • Module 3: NCHERM Policy Analytic
  • Module 4: Path to Good Decision-Making
