Frequently Asked Questions
September 29, 2023
In this newsletter, we will simplify common questions about working in Canada on a temporary basis, helping you navigate key aspects of the work permit system.
What documents are needed for a Canadian work permit?

Key documents include a Valid Passport or Travel Document, Biometric Data, Proof of Meeting Job Requirements, Proof of Relationships, and Completed Application Forms.
Can I apply for a work permit without a job offer?

Exceptions exist, such as the Post-Graduation Work Permit (PGWP) for recent graduates and the Spouse Open Work Permit for spouses of Canadian permit holders.
Who is eligible for an open work permit in Canada?

An open work permit is a versatile option that allows you to work for almost any Canadian employer. Eligibility for an open work permit can include:

  • Recent graduates from Designated Learning Institutions are eligible for the PGWP.
  • Dependent family members of applicants for permanent residence.
  • Spouses or common-law partners of skilled workers, international students, or Atlantic Immigration Pilot Program applicants.
  • Refugees, refugee claimants, protected persons, and their family members.
  • Those under an unenforceable removal order, temporary resident permit holders, and young workers in special programs.

Open work permits provide greater flexibility in terms of employment choices within Canada.
Can I bring my family to Canada on my work permit?

If you have a valid job offer from a Canadian employer, it comes with some great perks for your family:
  • Your spouse and dependent children can join you in Canada.
  • Your spouse or partner can apply for an open work permit, allowing them to work for most Canadian employers.
  • Under specific conditions, dependent children of temporary foreign workers can also qualify for work permits, study permits, or a Temporary Resident Visa.
  • This means your entire family can share in your Canadian experience, making it more enriching and fulfilling.
What are the types of work permits in Canada?

In Canada, there are two main types of work permits:

LMIA-Supported (Closed) Work Permits:
  • Tied to a specific job offer from a Canadian employer.
  • Requires a positive Labour Market Impact Assessment (LMIA) to ensure no negative impact on the Canadian job market.
LMIA-Exempt (Open) Work Permits:
  • Available through programs like the International Mobility Program (IMP).
  • Doesn't require an LMIA, providing more flexibility for job changes and employers.
Your eligibility for a work permit depends on your unique situation and the program you apply under.
How long does it take to process Canadian work permits?

Canadian work permit processing times can vary, typically ranging from one to nine months. The clock starts ticking when Immigration, Refugees and Citizenship Canada (IRCC) receives your completed application and stops when they make a decision. The duration is influenced by factors like application type, completeness, ease of information verification, and your prompt response to any requests or concerns from IRCC.
Can I change my status from visitor to worker in Canada?

Yes, if you enter Canada as a visitor but later secure a job offer, you can change your status from visitor to worker. To do this, you would typically apply for a work permit from within Canada. However, you must ensure that you meet the eligibility criteria for a work permit, such as having a valid job offer and the required qualifications.
Can I get permanent residence while on a work permit in Canada?

Yes, work permit holders in Canada can apply for Canadian permanent residence through the Canadian Experience Class (CEC). To qualify, they need at least 12 months of full-time skilled work experience in Canada within the past three years, along with the required language skills based on their job category. CEC is a popular route for those moving from a work permit to permanent residence in Canada.
