*OCTOBER HIGHLIGHTS*
May all the Patriots Stand Up
It may have sounded like a joke but the military dispensation is taking this very seriously. From the Patriotic Bill to Amendments to the Criminal Law Code, Zimbabwe is taking steps to punish its citizens who speak about its human rights record to foreign governments and the UN mechanisms, or arrange protests that coincide with major international events. This is according to the Cabinet Briefing of 27 October 2020.  Dr. Musa Kika of the Zimbabwe Human Rights NGO Forum says these proposed laws are nothing but unpatriotic. ZimRights has condemned the proposed laws as an attack on fundamental freedoms. ZimRights National Director Dzikamai Bere says citizens who objectively and constructively criticise their government are good and patriotic citizens. They must be honoured.


Suspension of By Elections
Minister of Health and Child Care on 2 October 2020 through Statutory Instrument (S.I) 225A of 2020 suspended by-elections citing the Covid -19 Pandemic. Vice President Constantino Chiwenga who doubles as the Health Minister said that by elections, which were slated for December 5, 2020, would be suspended in terms of section 68 of the Public Health Act (Chapter 15:17). ZimRights saw this as an attack on democracy after the MDC T, currently under the leadership of Ms. Thokozani Khupe recalled representatives chosen under the MDC Alliance banner. We asked ZimRights members to respond to this development. 87% feel this was a direct attack on the electorate. See our statement here


Political Prisoners
The denial of bail to prisoners of conscience continued. Terrence Manjengwa arrested on 24 August for protesting at the Harare Magistrates court over the arrest of Zengeza West MP Job Sikhala is still languishing in jail two months on. Manjengwa was recently blessed with a baby whom he is yet to see because of his continued incarceration. ZimRights spoke to Manjengwa before he was placed in custody. Here Manjengwa speaks about his ordeal at the hands of the police.

ZINASU president Takudzwa Ngadziore (22) arrested on 10 September for addressing a press statement 101 meters from Impala Car Rental demanding that Impala discloses information relating to the abduction of 22 year old MSU student Tawanda Muchehiwa was only given bail by the High Court on 16 October 2020 on after spending 36 days detained.

Active Solidarity with Citizens Under Attack 
Many of our members remain a target of attack for their good work. We are standing with them. Three children escaped death by a whisker while property worth hundreds of dollars was destroyed after a hut belonging to a ZimRights member and Pastor with Africa Maranatha Faith Ministries, Lloyd Mapfumo caught fire in a suspected case of arson on the 2nd of October. The Mapfumo family has been pushing for children's rights in the area and speaking against partisan distribution of food aid in the community. Villagers suspect this could be the reason for the arson attack. ZimRights response team led by Mashonaland West Chairperson Rev. Chabonyonga and Programmes Coordinator Mr. Leo Chamahwinya visited Rev Mapfumo’s family and assisted with rebuilding his home. Extra Judicial Killings
Members of the Zimbabwe National Army (ZNA) fatally shot two people on 30 September 2020 at Chisuma Business Centre, Victoria Falls after a misunderstanding. The soldiers that had been camped at one of the Primary School in Kachechete village ward 3 under Chief Mvuthu opened fire on the two civilians. ZimRights expressed concern over the increased extra judicial killings by the security forces. On the 11th of October, one person died after a shootout between intruders and security at former Zanu PF national Commissar, Lieutenant General Engelbert Rugeje (Rtd), homestead.

Police Brutality: On the 12th of October, Seven police officers, threw teargas canisters into a bus full of passengers at the Harare show grounds. ZimRights calls on the police to desist from being a force and become a service. On 22 October 2020,in Zaka, minors killed a soldier after he took the law into his hands and went on a revenge mission. He forced himself into a homestead of a family after the member of the family allegedly burnt his parent’s house and assaulted a woman. In defense of their mother the offenders attacked and killed the soldier.

YOUTH BILL OF RIGHTS: A CALL TO LEAD TRANSFORMATION
Did you know that the constitution has a section dedicated to the Youth and what they should expect from the state? We call this the Youth Bill of Rights in Section 20 of the Constitution. ZimRights National Director, Dzikamai Bere on 9 October 2020, at the invitation of Silveria House and the Catholic Commission of Justice and Peace (CCJP) reminded young people in Zimbabwe that they should claim the promise of the constitution by championing human rights . Bere noted that there was a huge gap between what the constitution provides and reality.

PARTICIPATORY DEMOCRACY AND CONSTITUTIONALISM
CREATING ROOM FOR EVERYONE
ZimRights is one of the co-hosts of the 3rd National Citizens Convention that runs from 4 to 6 November 2020. Our session, together with the Zimbabwe Human Rights NGO Forum is on Participatory Democracy and Constitutionalism : Creating Room for Everyone, runs on 5 November 2020 from 2:30pm to 3:30pm. Session will feature Tendai Murisa, Tony Reeler, Jacqueline Rukanda and Dzikamai Bere. Register here to participate in the convention.
02 - 06 NOVEMBER 2020 : GENEVA PEACE WEEK
INSIDER MEDIATION: BUILDING PEACE FROM THE INSIDE
ZimRights is excited to be participating in this year’s Geneva Peace Week, a leading annual forum on the international peacebuilding calendar. This year’s Geneva Peace Week is running from 2 – 6 November 2020. Read more about the Geneva Peace Week here. ZimRights National Director Dzikamai Bere will be part of the panel which will discuss Insider Mediation: Building Peace from the Inside. The session is convened by Search for Common Ground, Berghof Foundation, Interpeace and UNDP. The session will be on 4 November 2020 from 19:30 – 20:45 (CAT).

REPORT OF THE NATIONAL INQUIRY INTO ACCESS TO DOCUMENTATION
ZIMBABWE HUMAN RIGHTS COMMISSION
On 30 September 2020, The Zimbabwe Human Rights Commission launched the Report of the Inquiry on Access to Documentation. The Report finds, among other shocking findings, that over 2,3million children in Zimbabwe have no birth certificates, a wholesale violation of the right to identity. COMMUNITY ADVOCACY
INTRODUCING THE ZIMRIGHTS YOUTH ZONE
ZimRights believes young people have a role to play in building a culture of constitutionalism and respect for human rights. This is why in the month of October we launched the ZimRights Youth Zone aimed at supporting young people in their quest to champion human rights. The ZimRights Youth Zone is partnering with High Schools, Tertiary Institutions and any other centres of learning in establishing and resourcing Constitution Clubs. 5 high schools have so far signed up to the programme in Masvingo, Harare and Mashonaland East. ZIMRIGHTS AUDIBLE
HUMAN RIGHTS LAWYER MANDEVERE SPEAKS ON INORDINATE DELAY IN GRANTING BAIL
Bail is a fundamental right as enshrined in section 49 of the constitution that states every person has a right to liberty. However, despite these constitutional provisions, ZimRights notes a worrying pattern of inordinate delay in granting of bail especially to activists and human rights defenders. We speak to human rights lawyer Marufu Mandevere on this worrying trend.

ZIMRIGHTS COVID-19 RESPONSE
We continued partnering with health workers across the country to support the fight against COVID 19. With support from SIDA and IOM, we visited Chipinge, Buhera, Mt Darwin and Bindura and provided hygiene packs and face masks to help in the containment of the pandemic. After touring the nation meeting our members in their situation, Kenny is stirred to reflect on the meaning of human rights work to poverty stricken communities. What form must our human rights interventions take today, in communities that are ravaged by man-made poverty?
