Request for Comment on Proposed DOJ Rule Affecting Attorney Discipline

On March 5, 2026, the Department of Justice issued a proposed rule titled Review of State Bar Complaints and Allegations Against Department of Justice Attorneys. The proposal would allow DOJ to review ethics complaints against its attorneys arising from their federal duties before state or territorial bar authorities proceed with their own investigations, and asks bars to pause their reviews during that process.


This raises significant concerns. State courts license and discipline attorneys, and the Supreme Court has recognized that the regulation of lawyers is the responsibility of the states. The proposal also sets no deadline for DOJ’s internal review, which could delay disciplinary oversight.



Because of the significant implications for lawyer regulation and accountability, we encourage attorneys and law-related organizations to review the proposed rule and consider submitting comments before the public comment period closes on April 6, 2026.
