State Bar of Nevada

to Participate in ABA's Lawyer Wellbeing Study

The State Bar of Nevada will be one of 30 states to participate in a comprehensive study to assess mental health and well-being in the legal profession. Nevada lawyers have been randomly selected to receive the survey, and more communications will follow in July. More information on the study can be found here.

The study is being led by the ABA's Commission on Lawyer Assistance Programs (COLAP) and Krill Strategies. Their research represents a 10-year update to the landmark 2016 ABA-Hazelden Betty Ford study and will survey a random sample of actively licensed attorneys across participating states to provide the most comprehensive and statistically reliable picture of current mental health trends in the legal profession.

The study will examine multiple areas including mental health prevalence, substance use, burnout rates, the impact of technology and AI on attorney well-being, barriers to seeking help, and attitudes toward mental health resources like Lawyer Assistance Programs. Led by attorney behavioral health specialist Patrick Krill and Dr. Justin Anker from the University of Minnesota, the survey launches this summer with findings expected to be published in a peer-reviewed journal in early 2026.

The State Bar of Nevada's participation in this research demonstrates its commitment to supporting attorney well-being and will help inform evidence-based policies and resources to create a healthier legal community.

Lawyer Referral Service in Need of Attorneys

The State Bar of Nevada’s Lawyer Referral Service (LRS) has been serving the public since 1979 by referring clients in need of legal services to qualified attorneys statewide. The LRS serves the public interest by assisting individuals who can pay normal attorney fees but are unable to locate appropriate legal representation due to a lack of experience with the legal system, a lack of information about the type of service needed, or a fear of the potential costs of seeing a lawyer.

Lawyers who participate in LRS pay a $50 annual fee and, if retained by the client, remit 20 percent of all net fees earned and collected beyond the initial consultation fee to SBN.

LRS attorneys can opt to take an unlimited (or limited) number of clients statewide from a list of more than 20 practice areas. Attorneys are especially needed in the following areas: bankruptcy, civil rights, collections, consumer law, employment, immigration law, medical malpractice, real estate, Social Security, tax law, and workers’ compensation.

Do You Advertise? Don’t Forget to File!

Lawyers who advertise their services to Nevada clients — whether through conventional print, radio, or television media, or via online platforms — must file their advertisements with the state bar’s Lawyer Advertising Advisory Committee within 15 days of dissemination. Although law firm websites are not included in this requirement, all advertising disseminated in exchange for something of value must be filed.

Not sure how to file? Access the Lawyer Advertisement Filing Form, fill in the requested information, upload your media files, and remit the filing fee. Once the advertisement is submitted, the system will email an automatic confirmation.

A copy of the amended Nevada Rules of Professional Conduct and the Lawyer Advertising Interpretive Guidelines can also be found online. For questions regarding the filing process and/or submitting your advertising filing forms, please contact rhorne@nvbar.org

Featured CLE: Unlicensed Lawyering: Bad Idea

Paralegals, or nonlawyer assistants, must avoid engaging in the unauthorized practice of law, which includes tasks like evaluating cases, advising clients, or negotiating settlements, which are activities reserved for licensed attorneys under ethical rules. While paralegals may assist with tasks like gathering basic client information and performing conflict checks, responsibilities such as presenting retainer agreements or offering legal advice are strictly the lawyer's domain. Privilege and confidentiality rules also apply to nonlawyer assistants, underscoring the importance of discretion in all client-related matters.

Learning objectives of this webinar are:

  • Understand the boundaries of UPL and recognize which tasks are strictly reserved for licensed attorneys under the Rules of Professional Conduct.
  • Identify permissible duties for nonlawyer assistants, including appropriate ways to support client intake, conflict checks, and general procedural questions.
  • Recognize the ethical limitations surrounding retainer agreements, including why only lawyers may present, explain, or obtain signatures on such documents.
  • Apply the principles of attorney/client privilege and confidentiality to ensure that all client-related communications and information are handled in compliance with ethical standards.

This CLE is sponsored by the Paralegal Division.
