What do you do when your client's circumstances do not fit within a conventional immigration pathway — or when inadmissibility stands between the client and the status they need?
This seminar examines two of the most important discretionary remedies available under IRPA: humanitarian and compassionate applications and temporary resident permits. Through practical analysis and case scenarios, participants will learn how to identify the appropriate remedy, determine when it should be used, and build a persuasive application supported by the right evidence.
Topics include:
- H&C applications and TRPs: understanding what problem each remedy is designed to solve
- When an H&C application may be appropriate — and when it is not
- Establishment, family relationships, medical circumstances, country conditions and family separation
- Best interests of the child: developing and proving an effective BIOC analysis
- Bars, restrictions, risk considerations and strategic timing
- Building the theory of an H&C case and organizing persuasive supporting evidence
- Common reasons otherwise strong H&C applications fail
- H&C applications and the realities of removal and enforcement
- Using TRPs to address criminality, misrepresentation, non-compliance and medical inadmissibility
- Assessing need versus risk in a TRP application
- Using a TRP as part of a longer-term immigration strategy
- Choosing between H&C and TRP remedies — and when both may have a role
- Strategic sequencing: addressing the client's immediate problem while planning for the long-term immigration objective
- Practical case studies applying the WHO, WHEN, HOW and WHERE framework
