WE GUIDE YOUR BUSINESS OR REAL ESTATE TRANSACTION TO THE CLOSING TABLE
Greetings!
In December 2020, the City of Philadelphia passed a six-month moratorium on the eviction of smaller, owner-operated restaurants. As the moratorium is set to expire in early June 2021 (unless further relief is passed), we wanted to remind any struggling restaurant owner in Philly of a few key details:

  • During the one-year period that follows the expiration of the moratorium, a commercial Landlord must give a restaurant-tenant 30 day's notice of intent to evict (provided Tenant had given Landlord a Certificate of Hardship);

  • The Landlord is required to offer the restaurant-tenant a repayment plan for past due rent;

  • The Tenant is still obligated to pay past due rent. The Bill does not provide for rent forgiveness;

  • If the restaurant-tenant presents a risk of imminent physical harm, Landlord may still be able to evict

As we are all trying to do our part, please forward this email to your favorite Philly restaurant owner who may be struggling and could use some help. As always, we stand ready to assist in any way that we can.

Thank you very much.
