Top 10 Reasons to 1031 Exchange

#10 To consolidate or diversify real estate investments. By selling multiple properties and buying one larger replacement property, you lessen management responsibilities and may also be able to geographically consolidate property. For those investors who own one larger property, exchanging can allow them to sell and diversify into other types or locations without having to pay any tax.

Question Corner

Question- Can I buy into an Opportunity Zone Fund as my replacement property?

No. The same taxpayer rule for 1031 conflicts with the Opportunity Zone investment Fund requirement. In a 1031 you must take title to the replacement property in the same tax name as the relinquished property that was sold. Opportunity Zones regulations require that you purchase an entity interest in the Fund with in essence is a partnership interest. This violates the same taxpayer rule because the entity is a new taxpayer. Additionally, partnership interest purchases do not qualify for 1031.
