Board of Trustees in Brief

Report from the Board of Trustees Meeting on 09.15.2025
ICYMI, you can watch Village Board meetings online.

Good Cause Eviction Law Passed
The Board voted to adopt the Good Cause Eviction Law after opening and closing the public hearing in the same evening. Approximately twenty-four people spoke at the hearing. The Board had heard at previous meetings from Brian Callaci, the Chief Economist at the Open Markets Institute, Ann Korchak, the Board President of Small Property Owners of New York (SPONY) and Jason Hilliard of the Building & Realty Institute. The Board also heard from the Village's Housing Advisory Task Force which prepared a memo for the Board recommending against adoption of the law.
The Good Cause Eviction Law was passed by New York State in April 2024 and initially only applied to New York City, but municipalities can choose to opt into the law. Currently approximately 17 municipalities have opted in - 18 with Tarrytown's adoption of the law.
The Attorney General has a good summary of the law for tenants.
This page summarizes the impact of the law from the landlord’s perspective.
The law requires that landlords must renew a lease unless they have "good cause." Good cause criteria include:
- failure to pay rent
- engaging in nuisance behaviors
- refusing entry for repairs
-
and several other criteria
The law also prevents annual rent increases greater than 5% plus CPI or 10% (whichever is lower). This means that currently for municipalities that have opted into the law in our region, landlords would not be able to raise the rent above 8.79%. In some cases, the landlord would be able to justify a higher rent increase if the landlord has to make significant repairs and other considerations.
Certain units are not covered by the law including the following:
- Any unit in a building where rents are otherwise regulated by "statute, regulation, restrictive declaration, or pursuant to a regulatory agreement with a local, state, or federal government entity." This includes all ETPA units, Asbury Terrace, Franklin Courts and Towers and 10 Windle Park/62 Main Street among others.
- Any unit that received its certificate of occupancy after Jan. 1, 2009.
- Units that are owned as condos or co-ops.
A full list of exemptions can be found in the state law.
In addition, the Tarrytown Board chose to amend the state law to make the Good Cause Eviction Law applicable to more units by:
1) Changing the definition of small landlord from one who owns no more than ten (10) units in the state, to one who owns no more than one (1) unit in the state.
2) Changing the definition of high rent units from units that rent for more than 245% of Fair Market Rent to units that rent for more than 345% of Fair Market Rent.
The Local Law as adopted as well as an FAQ about the law can be found at the end of the meeting agenda.

Feedback on Proposed Changes to Main and White Street
The Board invited public comment on proposed changes to the Main and White Street intersection. The Village is already working with the Westchester County Planning Department on a sidewalk replacement project along White Street and the north side of Franklin Street. Because the Main and White Street intersection was highlighted in the Safe Streets for All survey as an intersection of concern, and has been the site of accidents in the past five years, the Village would like to expand the project scope to improve the intersection.
Proposed improvements include adding a crosswalk across Main Street, narrowing the roadway with sidewalk bump outs, beautifying the area with trees and plantings, and adding decorative street lights like the ones farther up Main Street. The Board received numerous comments of concern regarding removing parking in the downtown for local residents. The project designer will explore ways to add parking back so as not to lose spaces.
The Board also passed a resolution to approve an application to the Complete Streets Municipal Assistance Program to help fund the expanded project scope. The overall project cost for sidewalk replacements and intersection improvements on Franklin Street, White Street, and the intersection improvements is $2.45 million. The Village has $200,000 of grant funding from the Community Development Block Grant program; will apply for a grant 50% of the project cost ($1.225 million) from the Complete Streets Municipal Assistance Program, will provide at least $50,000 of in kind services and will fund the remainder of the project cost with General Fund Fund Balances, which are surplus funds returned to the General Fund at the end of a fiscal year when assets are greater than liabilities.
Additional information about the project can be found on the Village website including a link to the concept plan documents.
If you have comments on the proposed design, please email administrator@tarrytownny.gov.

Congratulations to 6 Tarrytown Firefighters for Recognition by the Westchester County Volunteer Firefighters Association
Six Tarrytown firefighters are being recognized by the Westchester County Volunteer Firefighters Association for their heroic efforts in combatting a fire that took place on Martling Avenue in December 2024. That tragic fire took the life of a 77-year old resident. Thanks to the quick and courageous efforts by Tarrytown firefighters, surrounding units were quickly evacuated, and the smoke and fire damage was limited to two adjacent units. In addition, when it was learned that there were no smoke detectors in the residence, the fire fighters worked in the days after the fire with the American Red Cross to donate and install detection devices for residents who need them. The six firefighters earning the Firefighter of the Year Award are Patrick Derivan, Sr., Raymond Tuohy, Patrick Derivan, Jr., Scott Weaver, Jr., Frankie Clark and Brayden DeNardo. They will be recognized as part of the WCVFA Convention and celebrations happening this weekend.
