This session will set the groundwork for the study of bank and payment processor responsibilities for due diligence, monitoring, periodic review, and coordinating Reporting of potentially suspicious activity to FinCEN, as well as the various rulemaking requirements for the rule-specific sessions in the series.

  • Introduction to the Consumer Protectors in Financial Services - August 5th at 2:00 PM ET

In the United States, several federal and state agencies serve as consumer protectors in financial services. It is important that banks and their third-party payment processors understand the various mandates and joint role in protecting consumers in financial services the United States.

In this session we will discuss the roles of the CFPB, FTC, FRB, OCC, FDIC, States AGs, and the DOJ in protecting consumers engaged in financial services and payments. We will also distinguish the difference between UDAP and UDAAP and how these terms apply.

  • Understanding and Implementing the Federal Trade Commission Marketing Practices Guidance - August 12th at 2:00 PM ET

Over the past 3 years roughly 60-75% of consumer protection enforcement actions imposed by the FTC relate to unfair and or deceptive marketing practices to consumers. In this session we will discuss the various marketing practices guides provided by the FTC to help businesses understand the various advertising and marketing practices requirements related to various consumer products and services.

While these marketing requirements apply specifically to businesses, both third-party payment processors and their banks need to be aware of these requirements as they conduct program due diligence on merchant customers prior to onboarding. Failure to do so could result in the TPPP and the bank being criticized for facilitating unfair and/or fraudulent activity by processing for irresponsible merchants.

  • Why it is Crucial that Banks and TPPPs Have a Thorough Understanding of the FTC's Telemarketing Sales Rule — Even If They Don't Process Payments for Telemarketers! - August 19th at 2:00 PM ET

The TSR has particular significance in financial services. Covered financial entities include

debt relief services companies, including credit counseling agencies, debt settlement companies, debt negotiation services, and similar providers. The TSR's debt relief services provisions impose strict requirements including a prohibition on collecting advance fees before delivering services.

Credit repair organizations, mortgage assistance relief services, and foreclosure rescue services, which must comply with the TSR, as well as payday lenders and other small-dollar lenders that solicit by phone. Auto financing and subprime auto lending companies, as well as auto warranty and service contract sellers must also comply, as well as credit card and rewards program marketers, "Recovery services" companies that purport to help victims recover money lost to fraud and investment opportunity/business opportunity sellers, who must comply with TSR provisions specifically applicable to investment and business opportunity offerings.

  • Understanding the Click-to-Cancel Rule (also known as the Negative Option Rule) and the FTC's Efforts to Modernize Negative Option Regulations for the Subscription Economy - August 26th at 2:00 PM ET
The Click-to-Cancel Rule was a landmark FTC effort to modernize negative option regulation for the subscription economy, requiring symmetrical cancellation, clear consent, and annual reminders. It was vacated by the Eighth Circuit in July 2025 on procedural grounds, but the FTC has restarted rulemaking in 2026 with the goal of issuing a procedurally-sound rule with similar substantive protections.

HOWEVER, the FTC continues active enforcement against problematic subscription practices under Section 5 and ROSCA, and state laws and litigation remain meaningful constraints. The substantive principles the rule embodied—that canceling shouldn't be harder than signing up, that consumers should consent to ongoing charges, and that material terms should be clear—remain very much alive even as the specific rule sits in regulatory limbo.

Whether you attend individual sessions or enroll in the full series, this program offers practical, timely guidance for compliance professionals, risk leaders, banks, and third-party payment processors looking to build stronger consumer protection programs. Reserve your spot and invest in training that delivers both regulatory insight and continuing education value.
