Important Compliance Reminder

Important Compliance Reminder from NABIP: Fees for MA and PDP Enrollment

as of September 9, 2025

Dear NABIP Member,

We have received several questions regarding whether licensed agents may charge beneficiaries a fee when enrolling them in non-commissionable Medicare Advantage (MA) or Prescription Drug Plans (PDP).

We want to make this absolutely clear: federal regulations prohibit agents from directly charging any fee to beneficiaries for marketing, consulting, or enrollment services involving MA or PDP plans, even if the plan does not pay a commission.

Federal Regulation: 42 CFR § 423.2274(c)(8) requires Part D sponsors to “ensure beneficiaries are not charged marketing consulting fees when considering enrollment in Part D Plans.” The same prohibition applies under Medicare Advantage regulations. Federal law preempts state law in this area. Even if a state permits Certified Insurance Consultants or Registered Investment Advisors to charge fees for other products, they may not do so for MA or PDP plans.

All compensation must come directly from plan sponsors and must comply with CMS regulations. Charging beneficiaries directly for these services places the agent at risk of regulatory enforcement and plan contract termination.

Thank you for your continued commitment to compliance and for serving Medicare beneficiaries with integrity.

Sincerely,

Jessica Brooks-Woods

Healthcare costs are up. Employer patience is down. Traditional plans aren’t enough—so what now?

👀 Healthcare costs are skyrocketing—up 9–10% annually—and employers are struggling to keep up. Meanwhile, employee expectations have changed. Traditional fully insured plans just aren’t cutting it anymore.

Smart brokers are stepping up with alternative funding models like:

✅ Level-Funded Plans

✅ ICHRA

✅ MERPs (Medical Expense Reimbursement Plans)

These plans offer more control, flexibility, and value—without compromising care. But it’s not just about the models—it’s about strategy.

🔍 That’s why Nonstop Administration & Insurance Services, Inc. and NABIP created this brief for brokers who want to lead the transformation:

“Winning in a Changing Benefits Landscape: Why Alternative Funding Models Matter for Brokers”

 📚Learn:

  • Why traditional funding is falling short
  • Why MERPs are gaining ground
  • What today’s HR leaders actually expect from brokers
  • How you can stand out, win more business & deliver real results

🎯 Now is the time to differentiate yourself. Download the brief, level up, and lead the change.

REBC Designation

Earning the Registered Employee Benefits Consultant® (REBC®) designation elevates your credibility as a professional. The field of employee benefits continues to evolve rapidly. A year does not go by without new government regulations, new or modified coverages, and new techniques for controlling benefit costs. To best serve their clients, professionals need to have a current understanding of the provisions, advantages, and limitations associated with each type of benefit or program as a method for meeting economic security.

NABIP Leadership Academy

NABIP's Leadership Academy assists chapter leaders and members to become better leaders in life and NABIP. Graduates, who complete the program by May 15, will be eligible for a discounted Annual Convention registration and will be recognized during NABIP's Annual Convention.

The Leadership Academy curriculum is comprised of 12 modules. The student gets to determine between live or pre-recorded modules .

The Academy year is July 1 through June 30. To ensure relevant content, modules may change from year to year. For this reason, students are highly encouraged to complete their studies in the 12-month cycle.
