Governor Whitmer Signs Executive Order Creating Eviction Diversion Program
Executive Order 2020-134 extending the temporary suspension of evictions until July 15 and creating the Eviction Diversion Program, which outlines a process for renters to get fast rental assistance or establish a manageable payment plan to keep Michiganders in their homes. Rental assistance under the Eviction Diversion Program will be available beginning July 16.
“No Michigander should have to worry about losing their home during a global health pandemic and, at the same time, landlords and management companies need rent from their tenants to sustain their businesses,” Governor Whitmer said. “This innovative new program will save lives, save money, and save businesses by keeping families in their homes and providing immediate financial relief to landlords for back rent they’re due.”
Under Executive Order 2020-134, $50 million of rental assistance will be made available in the form of lump sum payments to landlords in exchange for allowing tenants to remain in their homes, forgiving late fees and up to 10% of the amount due. Tenants whose back rent is not completely covered by the Eviction Diversion Program will be entered into manageable payment plans facilitated by Supreme Court Administrative Order 2020-17.
The program was created following the passage of Senate Bill 690, which passed unanimously out of both the Michigan House and Senate on June 17. The legislation appropriated $60 million in Coronavirus Relief Funding to the Department of Labor and Economic Opportunity for the creation of a rental assistance program to assist tenants and landlords after the eviction moratorium concludes.

Executive Order 2020-133 Allows Professional Sports to Return to Action
Governor Whitmer signed Executive Order 2020-133, which sets guidelines for the safe return of professional sports, without a live audience. The order follows Major League Baseball’s announcement that a shortened 60-game season would begin on July 24 with players reporting for spring training at their home ballparks by July 1.
Under Executive Order 2020-133, professional sports training and competitions can resume as long as the activities are conducted pursuant to a COVID-19 safety plan that is consistent with any guidelines from the Centers for Disease Control and the Michigan Department of Health and Human Services. Participants must also maintain six feet of distance from one another to the extent compatible with the sport.

State Lawmakers Pass Two Bipartisan Tax Relief Items Now Headed for Governor's Signature
the Michigan legislature passed 2 pieces of bipartisan tax related relief that was included in the Michigan Chamber’s Economic Recovery Agenda.
First, was HB 5761 and HB 5810 which will provide for a penalty and interest free extension of the summer 2020 property tax levy. Sometimes being the largest annual expense for a business, the summer property tax bill will be an obligation that some taxpayers simply will not be able to meet. Due to COVID-19 shutdowns many businesses have earned no revenue and will simply not be able to pay their property taxes.
Second, SB 935, SB 936 and SB 937 allow businesses to pay July and August’s sales, use and withholding taxes over an extended period of time. While accelerated filers have been excluded from similar relief provided by the Department of Treasury in the past, this legislation includes them.

Governor Creates Bipartisan Task Force, Takes Action to Protect Nursing Home Residents and Staff from COVID-19
On Friday, June 6, Michigan Governor Gretchen Whitmer signed executive orders to protect Michigan Nursing Home residents and staff from the spread of COVID-19. Executive Order 2020-135 creates the bipartisan Michigan Nursing Homes COVID-19 Preparedness Task Force within the Michigan Department of Health and Human Services (DHHS). The governor also signed Executive Order 2020-136, which extends existing safety measures to maintain restrictions regarding entry to care facilities designed to protect vulnerable populations. Since it was first issued on March 14, this order has prohibited entry into a nursing home without undergoing a rigorous screening protocol designed to protect facilities from COVID-19.
The Task Force will consist of leaders across state government, including representatives from DHHS and LARA. The task force will also include a representative of the Michigan Long Term Care Ombudsman Program, bipartisan representation from both houses of the legislature (2 members from each house), and thirteen other members appointed by the governor, including individuals with a personal or professional interest in the health, safety, and welfare of nursing home residents and workers.
Executive Order 2020-136 maintains restrictions on visitation to health care facilities, residential care facilities, congregate care facilities, and juvenile justice facilities, but authorizes the Department of Health and Human Services to gradually re-open visitation as circumstances permit. This order has been in place since March, and consistently prohibited entry into a nursing home by a person exhibiting symptoms of COVID-19. The order is effective immediately and continues through July 24, 2020.
