Congratulations to the Rotary Club of the Tarrytowns and the YMCA on a successful Duck Derby and Healthy Kids Day on April 27!

Kudos to the Tarrytown Environmental Advisory Council and their partners in Sustainable Sleepy Hollow for a packed month of events in April focused on sustainability. From the clean-ups along the lakes and the river, the Compost Giveback Day and seedling events, the Repair Café and the Village Free Day, there was something for everyone in the community to engage in caring for their community and the planet. Many thanks to all the volunteers who make these events happen.

Board of Trustees in Brief

Report from the Board of Trustees Meeting on 5.05.2025

ICYMI, you can watch Village Board meetings online.

Good Cause Eviction Law Presentation

The Board of Trustees heard a presentation on the Good Cause Eviction Law by Brian Callaci, the Chief Economist at the Open Markets Institute. The presentation can be seen here. This was the first of two presentations as the Board of Trustees considers whether to opt into the law. The Good Cause Eviction Law went into effect in New York State on April 20, 2024, initially applying to New York City only, but each New York municipality can choose whether to opt in or not.

The Good Cause Eviction Law does the following:

  • Prevents landlords from evicting tenants or refusing to renew a lease without good cause. "Good cause" includes non-payment of rent, malicious or grossly negligent substantial damage to the premises, unreasonable refusal of access for repairs, failure to refuse to reasonable changes to a lease, owner occupancy of the premises as principal residence, demolition, and others.
  • Prevents rent increases above ten percent, or five percent plus the Consumer Price Index (whichever is lower).
  • Does not cover certain buildings including buildings that are "otherwise subject to regulation of rents or evictions pursuant to local, state or federal law, rule, or regulation,"
  • Does not cover units that rent above 245% of HUD Fair Market Rents (FMR). This is because the law is not designed to protect tenants who can afford luxury rentals. A municipality can choose to set that exemption higher, for instance to 345% of FMR, as some have chosen to do. A listing of HUD Fair Market Rents and 245% of Fair Market Rents can be found in the NYS Homes and Community Renewal public notice issued in April 2025.

More information about the law can be found from the Attorney General. The full text of the law can be found here.

To fully understand potential tradeoffs that come with such new legislation, the Board will hear a presentation at the next Board of Trustees meeting on May 19 covering potential downsides to opting into the legislation.

Franklin Courts Re-Development: Conveyance of Road and Parcels

Following a presentation by representatives from the Tarrytown Municipal Housing Authority and WBP Development, LLC, and the closure of the public hearing, the Board of Trustees voted to convey two parcels including the Franklin Court roadway to help facilitate the re-development of Franklin Courts. The conveyance of the parcels allows for the re-configuration of the structures on the property to remove them from the flood zone and therefore reconfigure the entryway to the property. The conveyance is contingent upon the establishment of utility easements to ensure the Village maintains access to critical infrastructure. The full petition is posted online. The Board is still considering the request pertaining to maintenance of the sidewalk along Riverview Avenue.

303 South Broadway Zoning Petition Referred to Planning Board

The Board of Trustees voted to refer a Zoning Petition from the owners of 303 South Broadway, Amtrust Realty, to amend the Zoning Code to include an overlay Zone in the Office Building (OB) district that would enable residential and mixed use development for certain properties that meet the overlay zone criteria. A presentation at the April 23rd Board of Trustees Work Session can be viewed here.

The complete packet of petition documents can be accessed here: Dropbox Link.

The current proposal for the Overlay Zone requires:

  • properties sized between 5 and 10 acres
  • properties located north of I-287 and with frontage on Rt. 9 or Rt. 119
  • would need to provide meaningful public access to the property

Under this proposal, three properties would qualify for inclusion in the overlay zone:

  • 303 South Broadway
  • 120 White Plains Road
  • 150 White Plains Road

The current 303 South Broadway redevelopment proposal includes:

  • Adaptive re-use of the current building
  • 300-320 residential units
  • 4700 sq ft. retail space
  • Shuttle to train station
  • 1/2 acre public pocket park adjacent to Rt. 9
  • 10% affordable units (60% AMI) and 5% moderate income/workforce housing units (80-100% AMI)

The Planning Board will now review the Zoning Petition application, take on lead agency status for the environmental review process, as well as review the site plan application for the project, and ultimately refer the petition application back to the Board of Trustees for consideration after the Planning Board review is complete.

Public Hearing Scheduled for June 2nd: Battery Energy Storage Law

The Board scheduled a public hearing to consider amending the Zoning Code to allow for and regulate the installation and operation of Battery Energy Storage Systems (BESS) in the Village. The current proposal from Catalyze Tarrytown White Plains Microgrid LLC recommends an Overlay Zone that would apply to four properties in the Office Building (OB) and Mixed Use (MU) districts. Criteria for inclusion in the Zone include:

property must be at least 4 acres

Have a minimum setback of 100' to the battery cabinets with the exception of any property that borders I-287.

The four properties to which the overlay zone would apply are:

  1. 120 White Plains Road
  2. 200-220 White Plains Road
  3. 150 White Plains Road
  4. 303 South Broadway

Even if a property qualifies for inclusion in the overlay zone, a BESS proposal would still have to go through a site plan approval process with the Planning Board.

The Planning Board spent nine months reviewing the Catalyze application. They ultimately issued a Negative Declaration in their environmental review and recommend that the Board adopt the zoning amendment. In the process of review the Planning Board engaged a third party independent consultant to advise, particularly on the numerous safety questions that were raised. The consultant's report can be found in the application package. The Zoning Petition Documents can all be found at this link: Dropbox Link.

Battery Energy Storage Systems enable energy from renewables like solar and wind to be stored and released when the energy is needed most. To ensure the consistency and reliability of energy supply in the transition to cleaner energy sources with lower carbon emissions, battery energy storage is necessary. New York State has set a goal of installing 6,000 megawatts of battery storage capacity by 2030. In addition to helping meet state goals, the Planning Board found that support for Battery Energy Storage Systems is consistent with the Tarrytown Comprehensive Plan.

Members of the public and the Fire Department have expressed understandable concern about safety with Battery Energy Storage Systems in light of several high profile incidents using older more flammable battery technologies. The particular system being proposed has never had a fire in 2,000 installations over the last two years. The independent consultant's review of the proposed system can be found in the application packet. The consultant will also be on site at the public hearing on June 2nd to answer additional questions.

The presentation from the April 23 Work Session can be viewed here. The application packet can be found online here.

Purchase of New Fire Truck for Hope Hose Company

The Board authorized the purchase of a 2029 Model Pierce Enforcer Pumper for Hope Hose Engine Company No. 1 for the purchase price of $1,587,321.00 to be delivered in August 2029. The current Engine 79 is 24 years old. The Village will be using Fund Balance allocations to purchase the apparatus thereby avoiding the use of debt and saving money on interest expenses. The Board's discussion with the Hope Hose copany Fire Truck Committee can be viewed here. The resolution authorizing the purchase can be found in the meeting agenda.

National Police Week and National Public Works Week

The Board issued resolutions to thank members of our Police Department and Public Works Departments. National Police Week is May 11 through 17 and National Public Works Week is May 18 through 24. At the May 19 Board of Trustees Meeting, the Police Department will be in attendance to issue awards to officers for outstanding performance in the past year. Please reach out to the invaluable officers and staff we have in Tarrytown who work tirelessly to keep the Village, clean, healthy and safe.

Accepting Grants and Donations

The Board authorized the acceptance of a $78,671 grant award to pay for radios and a vehicle stabilization kit for the Fire Department. The Board also accepted a donation from James and Oak Fitzgerald for the ongoing beautification of the plantings around the Metro North Station. Finally, the Board accepted the donation of a bench at the Lakes soccer field from Boy Scout Lukas Contreras. Many thanks to the Fitzgeralds and to Lukas Contreras for your support for Village improvements. Thanks to the New York State Department of Homeland Security and Emergency Services for support for our Fire Department.

Paving Contract Authorized

This year the Village will be paving Oak Rise, Quarry Lane, Cottontail Lane, Deertrack Lane, Pintail Road, Whitetail Road, Mallard Rise, Crest Drive Ext., Lot G, Neperan Rd. portion near Egan’s Lot, and also the Warner Library Parking Lot for a total estimated contract amount to Tarrytown not to exceed $620,000, approximately half of which is funded by State grant funds.. The contract for paving is a shared bid among five Rivertown communities which helps. to bring down the cost.

Coming up:

The Board of Trustees will hold its next Work Session on Wednesday, May 14 at 6:00pm. The agenda can be found on the Village website.

Upcoming Public Hearings:

At the June 2nd Board of Trustees Meeting at 7pm in Village Hall, there will be two public hearings:

1) Business Change of Use Rules: Hearing to consider an amendment to the Zoning Code. The change would increase the amount of time that a landlord has to bring a business in to replace one that left. The law would change the time from six months to a year when site plan approval is required for a new business to open in a space in the downtown. Previously, if a space had been vacant for more than six months, a new business owner would have to secure Planning Board approval even if they were conducting the same type of business - i.e. one restaurant is replaced with another restaurant. This creates an extra layer of time and investment for the new business owner. Under the amendment, a property could be vacant for up to one year before the site plan approvals expire. Business owners will still need to seek building permits if doing any renovations, but this amendment should reduce some of the time required to open a new business.

2) Battery Energy Storage System Law: At the April 23rd Special Work Session, the Board heard a Zoning petition for a development proposed at 303 S. Broadway, and heard a petition for a new Battery Energy Storage System (BESS) law from an applicant looking to install a system at 120 White Plains Road.

Police Department introduces the Blue Envelope Program

The Tarrytown Police Department, along with other departments in the County, has introduced the Blue Envelope Program, designed to to better support drivers who are on the autism spectrum or who have communication challenges.

The Blue Envelope Program is designed to promote safe, calm, and effective interactions between drivers and law enforcement officers during traffic stops or other roadside encounters. Drivers participating in the program will keep a blue envelope in their vehicle, which contains their license, registration, and insurance information, along with clear instructions for both the driver and the officer on how to best communicate.

The program provides officers with important cues that the driver may have difficulty with eye contact, processing verbal commands, or communicating under stress. In turn, it gives drivers guidance on how to safely navigate an interaction with law enforcement, helping to reduce misunderstandings and promote a positive experience for everyone involved.

If you or a family member would like to obtain a blue envelope, please visit the Tarrytown Police Department at One Depot Plaza.
