Statewide Fiscal Intermediary RFP Submission Date Extended


The state Department of Health (DOH) has extended the submission date to a Request for Proposals (RFP) for a statewide Fiscal Intermediary (FI) to provide services under the Consumer Directed Personal Assistance Program (CDPAP). This was a provision in the final state budget for 2024-25.


The RFP is now due August 16, 2024 and the anticipated contract start date remains October 1, 2024. The date responses to written questions has been pushed to "on or about" August 2, 2024.


The contract term is for five years and subject to “to continued statutory authority and federal financial participation, successful contractor performance, and approval of the Commissioner of Health.”


HCA continues to oppose the establishment of one statewide FI and continues to advocate for allowing additional FIs to participate. In the meantime, we want to be sure all concerned HCA members are apprised of every material development with the program.

 

Minimum qualifications include: “An entity capable of performing statewide fiscal intermediary services with demonstrated cultural and language competencies specific to the population of consumers and those of the available workforce with experience serving individuals with disabilities and as of April 1st, 2024, is providing services as a fiscal intermediary on a statewide basis in at least one other state.”

Include, as attachments to the email, three complete distinct PDF files labeled “Administrative Proposal,” “Technical Proposal,” and “Cost Proposal."

 

Subcontractors

 

The statewide FI will be responsible for subcontracting with independent living centers that have been providing FI services since January 1, 2024 or earlier; and subcontracting with at least one entity per DOH managed long term care (MLTC) rate setting region (NYC area, Mid-Hudson/Northern Metro, Northeast/Western and Rest of State) that has a proven record of delivering services to individuals with disabilities and the senior population and has been providing fiscal intermediary services since January 1, 2012, or earlier.

 

Subcontractors may provide services and support functions that assist or enable the Awarded Statewide FI to perform FI services. Subcontractors may not directly perform any of the following:

 

  • enter into a contract for the provision of fiscal intermediary services with DOH;
  • set wages and establishing benefits for personal assistants (PAs);
  • maintain workers compensation, disability, or unemployment insurance policies for PAs;
  • appear at workers compensation, disability or unemployment hearings;
  • maintain personnel records for each PA and maintain records of Consumers’ service authorization or plan of care (subcontractors may maintain copies or duplicate records);
  • enter into DOH-approved memoranda of understanding with Consumers; or
  • enter into contract with managed care organizations.


The RFI describes the required FI services; organizational requirements; “Best Practices” (peer supports, home visits, PA orientation, consumer advisory committee); employment-related responsibilities; joint employment requirements; maintenance of a local presence in each region of the state; development of a Quality Management Plan, quality monitoring and reporting; Electronic Visit Verification (EVV) compliance; reviewing emergency preparedness and emergency plans; and more.
