Iowa Supreme Court Ruling Clarifies Above-Ground Storage Tanks As Nontaxable

An Iowa Supreme Court decision released last week provides a favorable outcome for many AAI members who have above-ground storage tanks. Below is a summary of the opinion from our legal counsel at BrownWinick:

In Chickasaw County Board of Review v. Property Assessment Appeal Board and Growmark, Inc., the Iowa Supreme Court delivered a significant victory for agricultural businesses and fuel distributors by clarifying that large-scale above-ground storage tanks are generally classified as nontaxable personal property. The court’s analysis centered on the dichotomy in Iowa Code § 427A.1 between real property "improvements," which are taxable regardless of whether they are attached to the land, and "equipment," which are only assessable as real property if they are permanently attached to a building or structure.

Applying the ordinary meaning of these statutory terms, the court determined that Growmark’s eleven 90,000-gallon propane tanks were "implements used for a specific purpose" (fuel distribution) and thus qualified as equipment rather than land-enhancing improvements. Because the tanks sat on concrete saddles held only by gravity and could be moved for approximately $28,124 each—a fraction of the $180,000 replacement cost—the court concluded they were not "attached" for purposes of § 427A.1(1)(d). Under this logic, these tanks are excluded from real property tax assessments and are exempt as personal property under Iowa Code § 427A.2.

For association members and other tank owners, this decision establishes that large storage containers—regardless of their size or how long they have sat at a distribution site—should be excluded from property tax assessments as long as they are unattached, movable without damaging the land, and primarily serve a specific business operation rather than providing a general utility to the real estate.

AAI Joins Letter Urging Action On Delayed Pesticide Approvals

AAI joined CropLife America and more than 40 state agribusiness associations this week in sending a letter to President Trump. The coalition is urging the Administration to direct the Environmental Protection Agency (EPA) to issue final approval decisions for crop protection products that have completed the review process but remain unregistered.

Several new pesticides that have cleared EPA’s full scientific review are still waiting for final approval that will allow farmers to access them. EPA scientists have found them safe for human health and the environment, but have faced delays in approval, some for more than two years.

The letter advocates for immediate action which would support the stated goals of the Administration.

IDALS Issues Guidance For New World Screwworm Protection

The Iowa Department of Agriculture and Land Stewardship (IDALS) issued guidance for livestock producers, pet owners, and veterinarians to help protect animals from the parasitic New World Screwworm (NWS) fly. The guidance comes after multiple cases of NWS have been detected in livestock in Texas and one infestation was confirmed in a canine in New Mexico.

The guidance includes information for importing livestock and companion animals into Iowa from an infested zone and best practices to protect against NWS. There are no additional requirements for animals originating in non-infested zones.

The NWS does not pose a food safety risk. Properly prepared meat and poultry are safe to eat.

All livestock caretakers and pet owners should routinely inspect animals for open wounds. If maggots are detected in an open wound of a warm-blooded animal, report it to IDALS immediately at 515-281-5305 or Animal.Industry@iowaagriculture.gov.
