Accommodation recordings - Recording Requirement Guide

Each county has recording standards that must be fulfilled on the document before recording. See below link to help guide documents sent to CLAS Clerking meet recording requirments

FinCen - Reporting

At this time, CLAS Clerking is still evaluating whether reporting for transactions is something we can assist with. FinCEN requires the collection of personal information, and we are currently assessing the best and safest way to implement a process that meets these requirements.

We are still able to assist with recording of documents in all Illinois and Wisconsin Counties. Deeds where the buyer is an entity, requires our designation form. (including trust)

Trust Deeds - Estate Planning

Reporting Clarification

When determining if reporting is needed you must review the trust agreement and determine if any new trustee's are being named, not contingent beneficiary

Example:

If Bob and Mary Smith deed their property into the Smith Family Trust:

  • If the trust certificate identifies Bob and Mary trustees of the trust, reporting is not required.

  • If the trust agreement names Bob, Mary, and their daughter Jane the trustees , the transfer may be considered reportable because Jane is now included in the transfer structure as of today.

  • Contingent beneficiary are not taken into consideration because the transfer is not happening at this time.

  • CLAS Clerking still requires our designation form, since we do not determine when something should or shouldn't be reported.

Designation Form

This form is an internal CLAS Clerking form that removes us from the reporting cascade “responsibility list” and, in most cases, places the document preparer in the reporting position when needed.
