National: Court Opens Group Path to Tariff Refunds for Importers
On October 8, a federal trade court ruled that businesses still owed refunds for the emergency tariffs the Supreme Court struck down in February can recover them together through a class action. The class includes any business that was the importer of record and paid those tariffs between February 1, 2025, and February 19, 2026, unless it already filed its own lawsuit. Businesses are included automatically. The court noted that many small importers have not used the Customs refund system, and about $30 billion has not been refunded. No refunds have been ordered yet, and a related government appeal is still pending. Businesses that imported goods directly during that period should watch for next steps in the case.
