Minnesota Paid Leave Effective January 1, 2026

What is it?

Paid Leave is a new program launching for Minnesotans in 2026. It provides paid time off when a serious health condition prevents your employee from working, when your employee needs time to care for a family member or a new child, for certain military-related events or for certain personal safety issues.

Premiums:

Deductions will begin January 1st, 2026. The first premium payments will be due on April 30th, 2026 and if you are with MHA payroll this will be completed on your behalf with the quarterly filings.

The premium rate for 2026 will be 0.88 percent based off gross wage per employee. The premium rate will change every year after that.

The premiums are shared between employees and employers. Employers must pay at least 50 percent of the total premium, though they may choose to pay up to 100 percent of the premium (note: this additional contribution will be reported as taxable wages on the employee’s W-2, and the employee and employer are subject to additional FICA taxes along with federal and state taxes for the employee). Employee deductions are capped at 50% of the premium rate.

Illinois Mandatory Annual Sexual Harassment Prevention Training

Members with employees working in the State of Illinois are reminded to provide and document annual employee sexual harassment training.

Every employer with one or more employees working in the State of Illinois are required to provide annual Sexual Harassment Prevention training to employees, regardless of their status (e.g., seasonal, part-time, etc.). The annual training requirement is based on a calendar year. New employees should be trained as soon as possible after being hired, then on an annual basis.

Employers may develop their own training program, provided it meets or exceeds the minimum standards outlined in Section 2-109 and Section 2-110 of the Illinois Human Rights Act (IHRA), or employers may use a model training developed by the Illinois Department of Human Rights (IDHR).

Training Resources At Your Fingertips

Employers are required to keep a paper or electronic record of all training, which may be a certificate or signed employee acknowledgement.

Additional training information and resources are available on the IDHR Training website.

When an Employee Passes Away: Payroll Steps to Consider

Losing an employee is a difficult experience for any workplace. While the focus is naturally on compassion and support, employers also have legal payroll responsibilities that cannot wait. Each state has specific rules about how and when final wages must be paid, and who is legally entitled to receive them.

It’s important to note that final wages should not be paid directly to the deceased employee. Payment must go to the legal recipient, which is most often the surviving spouse, a designated heir, or the estate’s personal representative. This ensures the payment is valid, legally compliant, and properly documented.

HANDLING PAYROLL WITH CARE

We recognize that losing an employee is a challenging time. Alongside the emotional and support needs, there are still payroll requirements that must be addressed. Asking a family for documents like a death certificate or proof of representation can feel uncomfortable, but it is necessary. These documents ensure that final wages are paid to the right person quickly and in compliance with the law.

Here are some general steps for you to take:
