Good Afternoon,
OSHA’s recording and reporting requirements play a critical role in protecting worker safety and health. These recordkeeping obligations assist employers, employees, and OSHA in identifying and addressing workplace hazards, helping to prevent future injuries and illnesses. There are two separate requirements that NYECA members must be in compliance with depending on the size of the company.
The first requirement is that employers with more than 10 employees are required to post the OSHA Form 300A Summary of Work-Related Injuries and Illnesses in a conspicuous location where employee notices are typically displayed under 29 CFR Part 1904, The certified summary, which must be signed by a company executive, must remain posted annually from February 1 through April 30 and reflect injury and illness data from the previous calendar year. The form must be clearly visible and may not be altered, defaced, or covered by other materials. The copy of the 300A must also be retained for five years. For employees who do not report to a fixed establishment, the summary must still be made accessible, such as through electronic distribution or posting by mail. Employers should also note that the full OSHA 300 log should not be posted due to confidential personal information unless identifying details are removed, and that the posting requirement is separate from OSHA’s Injury Tracking Application (ITA) electronic submission deadline of March 2.
Employers with 20 or more employees are required to electronically submit their injury and illness data to OSHA once per year, during the reporting period from January 2 through March 2 via Injury Tracking Application site submissions can be done manually, by uploading CSV/Excel files, or via API, with data needing certification by a company executive and adhering to specific data format rules. The purpose of this communication is to provide guidance on ITA submission requirements, reporting processes, troubleshooting support, and available resources.
