President's Corner

Larry Williams was elected as LGA's new President at the Annual Meeting held in Vidalia, LA on November 8, 2023. Check out his message on hopes for the LGA and what's coming this year.

Hello, LGA members and supporters. I hope that everyone had a wonderful winter and Mardi Gras holiday. Looking back on 2023, we are proud of such a successful year, with valuable time spent with our members and wonderful vendors that always show up to support the LGA.

As we head into Spring, we are working to create an exciting and fulfilling year for our members and supporters that includes more education and training at the LGA's GASTEC facility, another fun-filled Scholarship Golf Tournament in May, our Pipeline Safety Conference in August, and much more! The LGA Board of Directors is already hard at work planning and preparing for a jam-packed year and we are grateful to our members who always find a way to join us for the fun. If there is anything that we can do to help you get the most out of your membership, please let us know!

If you have any questions, please contact the LGA office at (225) 218-6885 or LGA@tatmangroup.com.

Sincerely,

Larry Williams, City of Walker

Louisiana Dig Law Amendment

House Bill 292 was approved and signed by the Governor which has become Act No. 344. This amendment to the “Dig Law” went into effect on August 1, 2023.

To summarize, this amendment states/clarifies the following:

• Reemphasizes that the marking of an operator’s facility or utility shall be provided for excavation or demolition purposes only.

• Clarifies the requirement that excavation or demolition activities shall begin not more than 120 hours (5 days) past the mark-by-time.

• Stresses the requirement for excavators/demolishers to use white paint, flags, or stakes to mark the proposed route or area of excavation/demolition for tickets called into the center. This is not required when entering a locate request online. (Considered “virtual white lining”).

• Requires potholing to expose specific types of utilities/facilities in certain situations with a special provision for forestry excavators.

Notice Required On Emergency Excavation

§1749.15 Emergency excavation; notice required; penalty

A. The notice required pursuant to R.S. 40:1749.13 shall not apply to any person conducting an emergency excavation. Oral or electronic notice of the emergency excavation shall be given as soon as practicable to the regional notification center or each operator having underground utilities and facilities located in the area and, if necessary, emergency assistance shall be requested from each operator in locating and providing immediate protection to its underground utilities and facilities.

B. The excavator shall certify in the notice required in Subsection A of this Section that the situation poses an imminent threat or danger to life, health, or property or is the result of an unplanned utility outage and requires immediate action and that the excavator, or owner, or operator has a crew on site.

C. There is a rebuttable presumption that the excavator failed to give notice as required pursuant to this Section if the excavator failed to give any notice to the regional notification center within the following time periods:

(1) Within two hours from the discovery of the need for an emergency excavation.

(2) In the case of a gubernatorially declared state of emergency due to a weather or homeland security-related event, within twelve hours of the beginning of the emergency excavation within the parishes to which the emergency declaration applies.

(3) In the case of a wildfire, within twenty-four hours after control of the emergency.

D. The owner or operator of the underground utilities, facilities, or submerged infrastructure shall respond to an emergency notice as soon as practicable under the circumstances.

E. Emergency excavation notices are valid for as long as the emergency situation exists. The type of work and location shall remain consistent with the work described in the emergency excavation notice. If the type of work and location become inconsistent with the emergency excavation notice, then a new excavation notice is required.
