Gene Hernandez- New YLWD Director

Opinion

It comes as no surprise to anyone who follows the continual antics of the Yorba Linda Water District that career politician, Gene Hernandez, who is currently serving on the City Council, was recently chosen to serve on the water board. Hernandez stated in his monthly Mayor's Corner address in December of 2023 that he would fill out his term on the Council that ends in November 2024. Plans change.

It comes as no surprise to anyone who follows the continual antics of the Yorba Linda Water District that career politician, Gene Hernandez, who is currently serving on the City Council, was recently chosen to serve on the water board. Hernandez stated in his monthly Mayor's Corner address in December of 2023 that he would fill out his term on the Council which ends in November 2024. Plans change.

Law Prohibits Holding Two Elected Conflicting Positions

State law prohibits elected officials from holding two elected positions if there is a “possibility of significant clash of duties or loyalties between the offices.” If the two offices are deemed “incompatible” by the courts, then the official is considered to have effectively forfeited the first office upon taking the second.

Incompatible offices can only be challenged with permission from the California Attorney General’s Office. The Los Angeles County District Attorney’s Office has filed several of these “quo warranto” lawsuits over the last decade against individuals who simultaneously sat on water boards and city councils.

Most recently, the D.A.’s Office sought and received permission in January to sue La Puente Councilman David Argudo (https://www.sgvtribune.com/2023/01/31/district-attorney-pushing-to-remove-la-puente-councilmember-from-office/), who also sits on the La Puente Valley County Water District. That case is still pending.

Hernandez to be Seated, January 11

Hernandez will be seated at the regular YLWD meeting on Thursday, January 11, in the seat vacated by former Director Wayne Miller. Miller stated that he resigned his seat because he did not have the support of the other directors, leaving some to wonder why you need the support of other elected officials to do your job.

Choosing Hernandez to fill out the remaining 10-month term of Miller, sets the stage for Hernandez to be re-elected in November 2024 and serve indefinitely as there are no term limits at the YLWD. Unless something better comes along, expect Hernandez to be a permanent fixture.

Big Power and Money Needed to Run

If you were thinking of running for one of the two water board seats in 2024, against Gene Hernandez and the current President Trudi DesRoches, recent former Director of the Diemer Water Plant, be sure to bring big power support and large sums of money. Otherwise, Outsiders Need Not Apply.

Another Plus for Hernandez

In 2022, Hernandez was a proponent of the failed high density housing Measure Z initiative, rejected by 75% of voters. The revised Measure Z - 2.0, to be re-named, will again appear on the 2024 ballot. Hernandez is less likely to be forced to deal with his high density support now that he has a seat on the water board.

Hernandez had already been endorsed by Directors Brett Barbre and Tom Lindsey for November 2024, despite the fact that Lindsey supported the dismissal of Barbre as YLWD President in 2022. Positions change.

Hernandez- Consistently Supported YLWD Rate Increases

The YLWD put off a proposed rate increase in October 2023, most likely due to the upcoming November election. But you can expect a rate increase following election when the directors are re-elected and secure. And, to add rate increase support to the YLWD Board, Gene Hernandez as the Council Representative to the water board, has consistently supported their rate increases.

YLWD Rate Increase Expected in 2025

A future rate increase should receive five votes from the board who consistently support recommended actions rather than fact-finding or other options. If all goes as planned, all five directors will be safe and secure for another 2-4 years and ready to support all suggested rate increases.

The YLWD saga continues!

January 16 Deadline

January 16 is the deadline to sign a petition to Repeal the Death Tax.

This bipartisan issue could be on the November 2024 ballot.

Opinion

_________________________

Were Voters Duped by the Fine Print?

In 2020, Prop 19 appeared to be only about helping wildfire victims and seniors. It was passed by voters who reportedly did not understand that they also approved a Death Tax with potentially devastating impacts. Among the fine print was the biggest property tax increase in state history, placed on the backs of people who have just lost a parent.

Prop 19- Untimely Bad News

For the first time in 30 years, a Death Tax hit children hard regarding family residences and businesses owned by their deceased parents. Under Prop. 19, property transferred from parents to children is reassessed to current market value, with limited exceptions. Grieving families receive a letter from the assessor’s office along with the sympathy cards. Many are forced to sell in order to pay the taxes.

Tax-Double-Dipping With a Tax Add-on

In other words, after a parent paid taxes on a property or business over the years, they are again taxed upon their death by the state. It the ultimate double-tax-dipping by the state with a current market value tax add-on!

A Chance to Vote Again

In November 2024, Californians may again have the opportunity to vote on this issue. If the proposition qualifies for the ballot and is passed, it will be retroactive for those who were impacted by the 2020 passage of Prop 19.

Another 1.2 million signatures are needed BEFORE January 16.

Who Will Save the Animals?

Dee Dee Friedrich fears for large animals in our city when the next big wildfire occurs.

In past years, volunteers worked to save large animals in wildfires but now resources are limited and membership has dropped, leaving Yorba Linda without help.

Dee Dee Friedrich

2013 Citizen of the Year

Dee Dee was honored by the City of Yorba Linda in 2013 for her heroic acts in saving

large animals during the Freeway Complex Fire. Friedrich has been a member of the Yorba Linda Country Riders since 1989 and has served as president since 2006.

She has served on the Large Animal Rescue Team since 2009.

_________________________________

On Saturday, November 15, 2008, Dee Dee personally rescued, and organized others to rescue, animals who were in the path of the fast-moving Freeway Complex Fire (FCF). Some animal owners could not reach home to rescue their animals or fled for their lives as the fire closed in.

With very little time to spare, Friedrich and her husband, Pete, roped squealing pigs and guided frightened horses into trailers. Risking their own personal safety with fire behind them and on both sides of the road, Dee Dee and Pete rescued numerous animals. Thankfully none were lost.

The FCF was an eye-opener in many respects including the realization that there was no plan to rescue large animals. In 2009, Friedrich joined the Large Animal Rescue Team (LART). Since that time Friedrich, and trained volunteers, have evacuated horses and livestock from wildfires all over the county.

Now, with reduced resources and only 50 active members, LART is limiting deployments to within the San Juan Capistrano city limits. That decision leaves large animal owners, throughout the county and Yorba Linda, to fend for themselves.

Many move to Yorba Linda for over 100 miles of trails, large lots for animals and open space but the downside is that our city is borders a Wildland-Urban Interface. As vegetation grows and provides increased fuel, large fires such as the FCF are expected every 10 years. The next big fire could occur on a weekday when many are at work and far away from their homes and animals.

We have gone full circle and Yorba Linda is again without a plan!

Who is the Yorba Linda Preservation Association?

Don La Commare, President

We are a non-partisan, action-oriented group that believes in preserving the character of our city and supports responsible housing in Yorba Linda.

We strongly oppose arbitrary state mandated housing initiatives leading to high-density/high-rise buildings in areas with already stressed infrastructure, which includes environmental, fire and traffic safety concerns.

We will work with statewide groups to oppose and remove ill-conceived state housing mandates.

We will partner with the City of Yorba Linda to appropriately place the remaining housing dictates within the city.

How to Remove Skunk Smells-Opinion

From a post on Facebook

________________________________

The best way we’ve found to remove the smell of skunk is:

1 bottle hydrogen peroxide,

1 tablespoon dish soap

1/4 cup baking soda

Sponge

Put first two in bowl, have the stinky one ready in sink and just before you sponge the mixture on add baking soda. Be VERY careful not to get it in nose or eyes. Massage through hair. Let it sit for 10 minutes before rinsing. Use your regular soap, rinse, dry. You literally can let them sleep on your bed after with no issues.
